The Conflict And Coordination Between Mongolian Marriage Customs And Marriage Law

Owing to the influence of historical and regional factors,the Mongolian nationality has a unique marriage custom,which has been preserved to this day.It can not be ignored that Mongolian marriage customs play an important role in adjusting marriage relations and resolving marital disputes.However,with the advancement of the national legalization process,there is a certain internal tension between the traditional Mongolian marriage custom and the current marriage law of our country,which is manifested in the marriage conditions and marriage.Procedures,divorce procedures,etc.As a result of this kind of conflict,caused some social problems,such as early marriage,close family marriage and so on.This article takes the Mongolian nationality as the research object,emphatically analyzes its extant marriage custom,and compares it with the current marriage law,analyzes the reason of its conflict with the marriage law,and explores the way to solve the conflict.In order to ensure the authority of the state law in the Mongolian region and respect and promote the good customs,so as to promote the integration between the Mongolian marriage custom and the national law.Firstly,this paper introduces the Mongolian marriage custom from three aspects: marriage custom,divorce custom and marriage society recognition custom.Then it expounds the conflict between Mongolian marriage custom and marriage law.The conflict is embodied in four aspects: the principle of freedom of marriage,the procedure of marriage,and the problem of raising children after divorce.These conflicts will lead to the corresponding social problems.And analyzed the causes of the conflict;Then the paper gives the adjustment strategy of Mongolian marriage custom and marriage law,in order to strengthen the propaganda of the rule of law,change the marriage concept of the Mongolian people,change the marriage custom that violates the marriage law,and keep the marriage and family customs in favor of promoting marriage and family customs.In order to promote the harmony between marriage and family relations and to accelerate the integration of customs and laws,the custom of marriage can not violate the law,but also keep and carry forward some excellent customs in order to promote the harmony between marriage and family relations and society and speed up the integration of customs and laws.
