Research On The Progress Of Marxist Legalization In China

Marxist jurisprudence is a component part of Marxism's complete scientific theoretical system and it is a law theory that has been tested by practice.China is a socialist country.Marxism is the party's belief,the theoretical basis for socialist construction and the theoretical source for the people to achieve ownership.Marxism is a theory of seeking truth from facts.When having problems in the process of dealing with China's revolution,construction and development,it needs to be integrated with Chinese reality.Only in this way can it be a better power to promote socialist modernization.Chinese Marxist jurisprudence is the civilization of the basic principles of Marxist jurisprudence.The study of the process of civilization of Marxism jurisprudence will be helpful for us to sum up historical experience,which is in the process of building the legal system.And when having real-world problems,we can have a more thorough,comprehensive and correct understanding of the important role of law in the modernization of socialism with Chinese characteristics.In this paper,the author clarifies the basic concept of Marxist jurisprudence at first.And based on it,he sorts out the historical process of its civilization from the perspective of the historical process of the Marxist legalization in China.It is found out that it includes five periods of development in the process of civilization of Marxist jurisprudence,such as a period of exploration,a period of devious development,a re-establishment phase,and a deepening of the development stage and new stage.Through analysis of different stages,we conclude that China's legal construction must adhere to safeguarding the interests of the proletariat;legal inheritance should insist on sublet the materialist dialectics.And take this as a world view and methodology study of studying the Marxist legalization in China.We learn some experience from the construction and development of China's socialism History that socialism must contribute to developing the legal construction.The legal construction must change the legal by conforming to the trend of the times.We must adhere to the views of law,which is combination of the rule of law and the rule of virtue,the people-oriented as well.And we must adhere to the experience of promoting ruling the country by law comprehensively.At the same time,through summing up experiences in different stages,we conclude that Marxist jurisprudence should follow the historical rules,preserve the truth,persist in sublet and agree to differ in the process of civilization in China.We must try to overcome the influence of five doctrines and feudal cultures on the processof Marxist legalization in China.We must adhere to the Marxist scientific legal view,uphold the leadership of the Chinese Communist Party,and be closely integrated with China's socialist legal construction practice,pay attention to cross-discipline research,adhere to the "people-oriented" and serve all human development.In the new era,in the process of civilization of Marxist jurisprudence,we should stick to the basic strategy of administering the country according to law,plan more important top-level design,pay more attention to the balance of public power,integrate into the construction of democratic politics,and the constitution should be amended to better reflect the will of the people.In this way,we can have a systematic,in-depth and novel interpretation of Marxist legalization in China.The author hopes that the experience and inspiration can provide some help to the advancement of ruling the country by law.And it can put forward its own thinking on the construction of the rule of law in a new era.
