In recent years,the mass violence incidents caused by doctor-patient disputes have been reported in newspapers,seriously endangering the normal order of medical institutions.Under the background of the development of "multiple dispute resolution",the people's mediation of doctor-patient disputes has become an effective way to resolve disputes.At present,various provinces and cities have set up people's mediation committees for doctor-patient disputes in light of local conditions,forming local patterns with distinctive characteristics.The People's Mediation Committee for Doctor-patient Disputes in City C is a typical example.The People's Mediation Committee for Medical Disputes in the City is still in the exploratory stage,which has produced some good social effects,but there are also some problems.Through empirical investigation,it is found that the operation of the core mechanism of the mediation source,the design of the mediation procedure,and the implementation of the mediation agreement has problems such as the disorder of the mediation main body,the difficulty in starting the mediation process,and the difficulty in fulfilling the mediation agreement.At the same time,the supporting mechanism failed to follow up well.The performance is as follows: the mediation training mechanism is absent,and the people's mediation mechanism for doctor-patient disputes is not adequately guaranteed.In view of this,this paper attempts to propose improvements from the core mechanism and the supporting mechanism.As far as the core mechanism is concerned,it is suggested to start from the following three aspects: First,optimize the mediation organization structure,optimize the mediation staff structure based on the knowledge structure,and establish and improve The system of chief mediators for disputes between doctors and patients;the second is to prescribe the procedures for mediation of medical disputes.It is recommended to clarify the pre-procedures for people's mediation of doctor-patient disputes on the basis of the existing Regulations on Prevention and Resolution of Medical Disputes;Perform the mediation agreement mechanism,check the mediation agreement in advance,and construct a refusal mechanism to punish the mediation agreement.As far as the supporting mechanism is concerned,we should focus on building a mediator training management system,improving the access system,raising the corresponding threshold and establishing a credit system for training methods;we must also improve the funding system,establish a funding grading guarantee mechanism,and exert social effects to introduce society.capital.
