Research On The Factors Affecting The Sentencing Of Trafficking And Transportation Of Drugs

Drugs are items that make our people talk about it.The Opium War of 1840 has become a pain that cannot be erased in Chinese history.Drug control is related to China's national security,social stability and people's health.At present,China is in the midst of a period of widespread drug abuse,and the anti-drug work is arduous and important.Drug trials are an important part of drug control work.This paper conducts research on 300 first-instance trafficking and transportation drug judgments,in order to find the current stipulations in sentencing according to the data,find effective solutions in combination with reality,and make recommendations.The first part: firstly analyzes the composition of trafficking and transportation of drugs,then interprets the documents related to sentencing,and then introduces the research methods.Finally,the factors of 300 first-instance judgments in A province are extracted,and the sentence is used as an independent variable.Drug count,number of times,drug recidivism,drug addiction,special temptation,ignorance,surrender,meritorious service,frankness,confession,recidivism,conviction,and master-accomplice,13 variables as independent variables,ten to 390 defendants Four variables were used for statistics,and Excel 2007 was used for data entry.Descriptive analysis was performed using SPSS 21.0 software.The second part: mainly discusses the relationship between drug gram and the period of punishment,SPSS analysis and qualitative analysis of the correlation between drug gram and sentence,and finds that there is a significant correlation between drug gram and the sentence,and found that more than 50 grams of drug cases have sentencing The problem of imbalance,and explored the relationship between the purity of drugs and the sentence,it is recommended to raise the upper limit of the term of imprisonment,gradually reduce the application of the death penalty for drug crimes,and expand the purity of drug identification to all drug cases.The third part: study the relationship between the number of trafficking and transportation and the sentence,SPSS analysis and qualitative analysis of the correlation between the number of times and the sentence,the number of times and the sentence are significantly related,and the number of cases involved is less than 10 grams.The case has a large impact,and the number of cases involved is particularly high.The defendant's crimes are not compatible.It is recommended that the number of cases involved be the sentencing standard for each sentencing range.The fourth part: This part studies the relationship between the drug crime plot and the sentence,and conducts SPSS analysis and qualitative analysis on the correlation between drug recidivism,recidivism,procedural,drug addiction and special inducement.There is a significant correlation between drug recidivism and drug addiction and sentence.It discusses the disputes between drug recidivism and recidivism,whether minors can apply drug recidivism,drug addicts to sell,the number of drugs transported,and special inducement cases.To deal with the problem,it is recommended to appropriately expand the scope of application of drug recidivism and to examine the investigative means and the accused subjectively at the same time when identifying the special circumstances.The fifth part: Studying the relationship between the general sentencing circumstances and the sentence,the SPSS analysis and qualitative analysis of the correlation between the two plots and the sentence of the attempted,surrender,meritorious,frank,confession,and the principal and the offender,found themselves,There is a significant correlation between confession and guilty attitudes and the period of imprisonment.It discusses the criteria for the unidentified identification of trafficking and transportation of drugs,the identification of accomplices and the application of the death penalty in joint crimes.It is recommended that the standards of drug crimes should be established as soon as possible and the position of discretionary plots should be established..The sixth part: summarizes the conclusions drawn from the SPSS analysis of this paper and looks forward to the next work direction.
