Research On The Rule Of Law Of Micro-terrrism

Today,terrorism has become an international nuisance.Countries have stepped up their efforts to combat terrorism and formulated a series of laws and regulations,investing a lot of manpower,material and financial resources to strengthen the control of the public sphere,but the resistance to terrorism has been constantly enhanced.The analysis of terrorism in the new era will reveal that terrorism in the Internet era is characterized by small-scale,decentralized and non-leadership,it also has gradually attracted the attention of relevant departments.The instant messaging function of the Internet makes the communication and information dissemination of human beings distributed all over the world cross the limits of space.With the help of the Internet,this kind of terrorism develops vigorously,and it can pool seemingly small forces into greater lethality.Such terrorism is the micro-terrorism to be studied in this paper.The purpose of this paper is to put forward specific suggestions on combating micro-terrorism at the level of the rule of law by analyzing micro-terrorism in an all-round way.The research methods used in this paper are literature research and comparative research.On the one hand,in the course of the study,a large number of domestic and foreign relevant information on terrorism have been collected for a comprehensive analysis.On the other hand,by studying the legislative system of foreign countries,we can learn from and innovate through comparison.The main innovations of this paper include two aspects.On the one hand,micro-terrorism has been innovatively classified.In this paper,whether the micro-terrorism activities carried out by dispersed terrorists are carried out under the leadership of specific terrorist organizations as a classification criterion,micro-terrorism is divided into micro-terrorism led by terrorist organizations and micro-terrorism led by non-terrorist organizations.Starting from the origin of "micro" in micro-terrorism,this classification covers different manifestations of micro-terrorism,which can make up for the lack of comprehensiveness in the existing theoretical system by conducting a more comprehensive exploration of micro-terrorism.On the other hand,this paper studies the balance between combating micro-terrorism and citizens' basic rights.From the current research status,although there are many related studies on counter-terrorism,the research on human rights protection based on micro-terrorism is not common.From the perspective of the contradiction and balance between combating micro-terrorism and citizens' basic rights,this paper analyses how to further balance the fight against micro-terrorism and citizens' basic rights in the current era of micro-terrorism,so as to promote the development of counter-terrorism work in China.The article is divided into seven parts.First is introduction,includes the background,research significance and related research status at home and abroad.The second part is an overview of micro-terrorism,including its definition and classification.It also introduces the causes of the development of micro-terrorism promoted by three networks:asymmetric confrontation theory,non-leader resistance theory and network radicalization theory,in order to better analyze micro-terrorism.In the next part,I introduce the domestic legal system of combating micro-terrorism,including the relevant provisions and deficiencies of criminal law,criminal procedure law and anti-terrorism law in combating micro-terrorism.The fourth part is to analyze the legal regulations of foreign countries in combating micro-terrorism,mainly choosing the relevant anti-terrorism laws of France,Russia and Australia.The fifth part summarizes the conflict between combating micro-terrorism and citizens' basic rights,which is manifested in the tense relationship with citizens' right to privacy,freedom of expression,right to know and equal rights.The sixth part is the countermeasure part,mainly on the basis of the preceding article,put forward the countermeasure of combating micro-terrorism and balancing citizens' basic rights in our country.The last part is a summary,which summarizes and prospects the research on the rule of law of micro-terrorism.
