| The term "Business Environment" is derived from the annual?Doing Business?"published by the World Bank in 2003.The World Bank's Business Environment Annual Report adopts an assessment of the business rules and implementation of each economy,to remind policymakers of the institutional and legal environment needed for the establishment,operation and development of private enterprises.Since the report was published,the commercial rule of law environment,which is consistent with new international economic and trade rules such as investment facilitation,trade facilitation,financing liberalization,intellectual property protection,and free movement of personnel,is a new field of competition for the business environment in the economic open pilot zone.The earliest domestic connection between the business environment and the rule of law environment is Guangdong Province.In September 2012,Guangdong Province formulated the "Guangdong province builds rule of law internationalization on the business environment five-year action plan".In July 2014,the Standing Committee of the Shanghai Municipal People's Congress passed the"China(Shanghai)Free Trade Zone Management Measures",the first local legislation on the rule of business environment.Based on the research of existing scientific research results,this paper combined the rule of law in the business environment of developed regions at home and abroad.It was divided into five parts:The first chapter is the introduction.The main system clarifies the significance of the research and summarizes the research content and research methods of the article.The second chapter combs and integrates the "The Belt and Road" and the business environment theory.The "The Belt and Road" initiative provides a basic guarantee for the development of the business environment of foreign economic and trade in China and the world,and the economic trade of the Tumen River region.The economic benefits brought about the prosperity and development of Northeast Asia's economy,the two complement each other and jointly help the implementation of the domestic "The Belt and Road" initiative,and play an important role in the actual socialist modernization.The third chapter introduces the reference to the rule of law in the business environment at home and abroad.The analysis of developed regions in New Zealand,Singapore,and Hong Kong,China,provides experience and relevant theoretical foundations for the development of the business environment in the Tumen River region and the rule of law in the business environment.The fourth chapter clarifies the main problems facing the current legalization of the business environment in the Tumen River region.First of all,the legislative system of the Tu Men River Free Trade Zone is not perfect.Secondly,the construction of the local taxation rule in the Tu Men River area is imperfect;the system of multi-disciplinary dispute resolution is inadequate;the rule of law government mechanism is lacking;finally,the Tu Men River area has insufficient professional talent reserves.The fifth chapter puts forward specific suggestions for the above problems.First,fully perform government functions in accordance with the law;improve the system of administrative systems according to law;promote scientific decision-making,scientific democracy and the rule of law.Second,expand tax incentives,further reduce tax burdens;enhance the industrial orientation of taxation policies;and improve the supporting coordination system.Third,the establishment of the Tu Men River rule of law government system,mainly from the full implementation of government functions in accordance with the law;improve the regional government administrative uniforms;strengthen the regional government public services in three aspects to propose basic theoretical countermeasures.Fourth,build a legal professional training system.Legal personnel training should deepen the professional level;strengthen exchanges with lawyers outside the cabinet;and innovation of legal service professionals. |
