Research On Restorative Justice System Under The Concept Of Radical Security

Restorative justice system is a new criminal justice system which is actively advocated by western countries to deal with crimes and restore social relations.In May 2017,the ministry of justice held a party group meeting and decided to include the reform of the prison system in the task of judicial and administrative reform.The fundamental purpose of putting forward and implementing the concept of security at the root is to reform criminals and build a harmonious society,which is consistent with the ideal goal of restorative justice system: to pursue judicial fairness and justice.The article is divided into six parts: preface,the first chapter,the second chapter,the third chapter,the fourth chapter and the conclusion.The preface includes the research background,significance,method and innovation of the thesis.The first chapter is about the restorative justice system under the concept of curative justice,which is divided into two sections: the first section describes in detail the meaning,characteristics,relationship between the concept of curative justice and the baseline security concept;the second section describes the origin,meaning,characteristics,application conditions and scope of the restorative justice system;The second chapter is about the significance of the concept of security on the macro and micro aspects of the restorative justice system.Chapter three discusses the basis and practical exploration of therestorative justice system under the concept of curative security.The basis of the restorative justice system includes ideological basis,organizational basis and policy basis.The practical exploration of the restorative justice system under the concept of curative security includes criminal reconciliation,conditional non-prosecution and community correction.Fourth chapter about the disease under the concept of restorative justice system,the main problems include: the applicable scope of the restorative justice system is not clear,the impartiality of agreement to perform supervision does not reach the designated position,insufficient community participation system of restorative justice,restorative justice system is lack of proceduralsafeguards,cure under security concept of restorative justice system perfect,the applicable scope of the restorative justice system,supervision and fulfill their good agreement,promoting community participation of restorative justice system and strengthening the procedural guarantee of restorative justice system.Combining with the actual situation of our country,the research on restorative justice system under the concept of radical security plays an important role in promoting the harmonious development of our society and judicial reform.
