Research On The Implementation Problems And Countermeasures Of Community Correction System Under The Concept Of Restorative Justice

Restorative justice advocates that through the joint participation of all parties,the social relations damaged by criminal acts can be restored,and the purpose of correcting criminals and preventing crimes can be achieved.In recent years,the concept of restorative justice has been applied more and more in the field of criminal justice,and community correction system is one of them.There are many similarities between the concept of criminal justice advocated by community correction and the value pursuit of restorative justice.The Community Correction Law has made the community correction system reflect the spirit of modern criminal justice.However,due to the restriction of traditional severe punishment thought and social development level,the development of community correction under the concept of restorative justice faces many problems and deficiencies.How to break the bottleneck of community correction?How to promote the further standardization,specialization and rule of law construction of community correction? How to realize the purpose of repairing social relations,reshaping criminal personality,preventing and reducing crime?We must solve the problem.This paper Starting from the perspective of restorative justice,taking the implementation of the Community Correction Law as the starting point,and combining with the actual situation and problems in the process of community correction in Z city of Ningxia where the author is located,this paper analyzes the problems and causes of community correction in China under the concept of restorative justice,and explores and puts forward countermeasures and suggestions by comparing with community correction models in the United States,Germany,Shanghai and Beijing.In the introduction part,the background and significance of the research are briefly described,and the relevant research situation at home and abroad is summarized.The first chapter is an introduction of the concept of restorative justice and community correction.This paper explains the emergence,practice,nature and connection of restorative justice and community correction,and lays a foundation for the following research.The second chapter analyzes the feasibility of the deep integration of restorative justice and community correction in China from the aspects of ideology,theory,social culture and so on.The third chapter combs the present situation of community correction in Z city,and analyzes the existing problems and their causes.The fourth chapter compares the domestic and foreign community correction models such as the United States,Germany,China’s Shanghai,Beijing,etc.,to provide reference for the practice of community correction under the integration of restorative justice concepts in China.The fifth chapter discusses the solutions to the problems faced by China’s community correction under the concept of restorative justice,from the perspectives of the penetration and conversion of law enforcement concepts,the norms of social forces,the strengthening of law enforcement forces,and the improvement of supporting systems and measures.Draws the conclusion.
