Juvenile justice,according to the literal understanding refers to the juvenile justice system,is to prevent juvenile delinquency and formed a different legal system from adult criminal justice.Restorative justice is a profound reflection on retributive justice and aims to restore social relations and community order damaged by crime in a non-confrontational way.In the prevention and governance of juvenile crime,there are many similarities between the two,and in the future development,gradually formed a special restorative juvenile justice model.Throughout the development of juvenile justice in China,since the establishment of juvenile court in Changning District of Shanghai in 1984,juvenile justice in China has experienced decades of development and gradually formed a processing mode guided by "two laws and one chapter" and coordinated by various departments,which has played a great role in the prevention and treatment of juvenile crimes.Although China has made great progress in the construction of juvenile justice system,there is still a big gap with the truly independent juvenile justice system,and the construction of independent legal system,complete judicial procedures and professional organization system remains to be improved.In order to improve China’s juvenile justice system,it can be considered to take the concept of restorative justice as the guide to comprehensively reform the juvenile justice system,starting from the three aspects of legal system,organizational system and case processing process,to establish a more complete restorative juvenile justice system independent of the adult criminal justice system.We will make better use of the juvenile justice system to prevent and treat juvenile crimes.
