Analysis On The Collection System Of Legislation Projects

The collection of local legislative proj ects has many years of practical experience in the process of local legislation in China.The construction of local legislative proj ects in different places is different,and it is relatively fragmented and unsystematic.At the Third Plenary Session and the Fourth Plenary Session of the Eighteenth Central Committee,and the National Congress of 2018,both the scientificization of the national governance system has become more prominent.This also requires us to do a good job in top-level design,adhere to the party's leadership,improve the local legislative project procedures,and promote the rule of law and procedural construction of the system.Local legislation is divided into local laws of local people's congresses and local government regulations.Whether it is local regulations or local government regulations,it seems like the congresses dominate the local legislative process.In fact,the preliminary work is basically finished by legislation office,like establishing,demonstrating and drafting,and the congresses have only demonstrated their sense of existence during the deliberation process.By interpreting the connotation and structure of the system,we should expand the meaning of "project collection",and sort out the main body,object,deadline,standard,in order to clarify the project collection system.The collection of local legislative proj ects in China conducted in Yunnan Province in 2002,and promoted in Sichuan and other places,mainly in the legislative process of the provincial people's congress and its standing committee to formulate local regulations.Whether it is formal or substantive,it promotes the democratization of local legislation in China,and is scientific on the basis of democratization,improving the quality of local legislation.At present,there are imbalances in the collection of local legislative projects in China in terms of geography and project areas.The progress of collection work varies from place to place,the degree of public participation varies greatly,and the degree of procedural,legalization and accuracy of the collection of the project is accurate.Since the "Legislation Law" in 2015 gave the city's local legislative power and restricted its authority to urban construction and management,environmental protection,and historical and cultural protection,the collection of legislative items has a large proportion.In addition,the local legislative projects solicited are unbalanced in the legislative reform,and waste project promotion,focusing on the legislative construction in the narrow sense,but not paying much attention to the revision and abolition of the established local regulations and government regulations.In addition to the investigations between the urban areas of the districts,the provincial level and the municipal level of the districts also have large gaps in the practice.Shanghai is the vanguard of the collection of local legislative projects in China.Through the empirical research on the work in Shanghai,it seeks to manage the leopard,and examines the system construction,channel innovation,participation of NPC deputies and the conversion rate of the project.The defects and shortcomings in the process of collecting legislative items,clarifying the influencing factors of the effectiveness of local legislative projects,and collecting the right questions for the collection of local legislative items in China.At present,in the process of collecting local legislative projects in China,the enthusiasm of public participation is reduced.The costs of participating are relatively high,and the awareness is not strong.The division of authority between the collection subjects is unclear,and the interests of the departments are enlisted in the process of project collection.There are contradictions between the collection targets,and the negotiation mechanisms between the party,the people's congress and the CPPCC are not smooth and lacking of platform.In addition,the power between the government and the people's congress is not clear,and the participation of the people's congress is not apparent.At the same time,the system lacks a supporting mechanism,and there is no complete institutional chain to ensure the implementation of local legislative proj ect collection.For the above problems,the enthusiasm of citizens to participate in the collection of projects should be enhanced,and incentive mechanisms,feedback mechanisms,public tracking and effectiveness mechanisms should be established and the legal binding force of the projects should be clearly identified.Ensuring citizen participation also requires us to innovate and collect new ways,implement project research at the grassroots level,build a new negotiation platform,innovate and develop legislative grassroots contact points and borrow external tools such as big data technology and artificial intelligence technology to assist in project collection.In addition,the institutionalization,rule of law,programmatic advancement of the legislative project collection system and the combing of its content structure will also improve the efficiency of the collection work and reduce the resistance and internal consumption of proj ect collection.
