The Detailed Study On The Legislative Mechanism Of Local People's Congresses

Since the 18th national congress of the communist party of China,the rule of law has been included in the "four comprehensives" strategy,ushering in a new era of building a law-based China.Article 52 of the legislation law stipulates: "to solicit opinions extensively,conduct scientific argumentation and evaluation,determine legislative items according to the needs of economic and social development and democratic and legal construction,and improve the immediacy,pertinence and systematicness of legislation." As the basic work of the legislative work of local people's congresses,the legislation of local regulations plays an important role in balancing the legislative structure of local people's congresses,optimizing the sequence of legislation and regulating the relationship between legislative supply and demand.But all the time,the practice of the legislative work in various places reflects that the legislative work has not been institutionalized and standardized and there are some problems such as rough legislative program design of local people's congresses.This paper mainly takes the legislative establishment of local regulations as the research object,starts with the current status of legislative establishment of local regulations in 15 sub-provincial cities,and analyzes the legislative establishment of local regulations in Harbin.By combining the Harbin city people's congress and its standing committee of the legislative regulations and the actual situation of Harbin place National People's Congress legislation project work,to solicit legislative proposal project time,legislative proposals,project sources,local people's congress legislation project demonstrates three aspects carries on the analysis,to the local people's congress legislation mechanism of refinement were studied.Specific from the following aspects of the local people's congress legislation for refinement and improvement: To determine the start time of the project of soliciting legislative proposals;Broaden the access to legislative projects,give full play to theleading role of local people's congresses in legislative work,and explore legislative themes through multiple channels;Give full play to the positive role of public participation in the legislative work of local people's congresses;Establish scientific criteria for project approval.From the content and procedure of the elaboration of the demonstration of the approval of the project,we hope to be able to play a positive role in the elaboration of the local regulations.
