Legal Protection Of Women's Labour Rights

On December 27,2015,the 18th meeting of the Standing Committee of the 12th National People's Congress reviewed and approved the proposal to amend the Population and Family Planning Law of the People's Republic of China.Based on the policy considerations of China's“aging”trend,the revised law clearly states that the state encourages a couple to have two children.However,the introduction of the"two-child policy"has made the existing employment discrimination more serious.Whether it is unmarried women or married women but just raised a child,all of them should have enjoyed the"second child policy".The right to meet more serious challenges.The protection of women's labor rights and interests is an urgent problem to be solved in China.The equal protection of women's labor rights is a historical and inevitable choice of the world.On the basis of summarizing the existing research results,this paper expounds the importance of women's labor rights protection in the era of the second child policy.The first chapter of this paper is based on the theory of justice and the theory of social responsibility as the legal basis,defining the concept category of women's labor rights,and clarifying that women's labor rights are the bundle of rights including the right to work,the right to work,and the right to receive benefits.Human rights,social and economic aspects reaffirm the significance of the protection of women's labor rights.The main content of the second chapter is the problem of women's labor rights in China,especially the impact of women's work rights,remuneration rights and welfare rights under the implementation of the second child policy,and the legal reasons for the impact.The third chapter of the system improvement thinking is based on substantive equality.Based on the analysis of the legal reasons in Chapter 2,the relevant opinions and suggestions are put forward from the legislative concept,legislative content,accountability mechanism and relief mechanism.Finally,on the basis of the full-text analysis,it is reiterated that women's labor rights are an important part of women's human rights.We should not neglect the protection of women's labor rights due to major adjustments in population policies.We should establish and improve women's labor rights guarantee system in an effort to achieve real Achieve a dynamic combination of formal equality and substantive equality.
