In recent years,the socialist market economy with Chinese characteristics has been developing rapidly,and the status of the great power has been significantly improved.Chinese international appeal and influence are improving constantly.Along with the prosperous economic and trade contacts,there are transnational population flows.With the continuous increase of the number of foreigners in China,there are some problems such as the lack of illegal employment rules for foreigners,and incomplete employment protection system for foreigners.In the face of these emerging problems,we should seek solutions actively.Human rights is the theoretical foundation for protecting the right to work of foreigners.The basic principles of protection of work rights have been established in international law.For the protection of foreigners' right to work in China,It is necessary to proceed from the protection criteria for the right to work of foreigners stipulated in international human rights treaties,and define the obligations of treaty law in China.We should make a comparative study on the system of working right protection in the European and American countries and Japan,and find out what we can use for reference.For the protection of foreigners' right to work.It should also be realized that there is currently insufficient constitutional protection in our country,and the lack of specific legislation,and problems with the legal system.The solution to these problems can be solved by improving constitutional protection,strengthening legislative protection,and promoting international cooperation.
