Research On Legislation Of Urban Reclaimed Water Utilization In China

As a new type of water resource,reclaimed water is the inevitable choice for thecountry to promote water resource conservation,control water pollution and develop circular economy.Maximum conservation of natural resources is an important link to achieve the renewable use of water resources.The utilization of urban reclaimed water can effectively alleviate the serious shortage of water resources.As of 2017,China's urban sewage discharge totaled 699,661 million tons,according to a report by the national bureau of statistics.The extreme shortage of fresh water resources,coupled with the huge annual sewage emissions,make our country have to water stability,reliable supply of sewage waste into a treasure,to play its potential for recycling.Exploring since the 1950 s practice in our country,and has obtained certain achievements,such as legislation,sewage treatment,reclaimed water use have made some related regulations,but has not been introduced at the national level specialized legislation of reclaimed water,and the current urban reclaimed water use legislation has not yet built up a complete legal system,faces a "small,scattered distribution,weak and narrow coverage",etc.In the face of the benefits brought by the utilization of urban reclaimed water,the state should improve the legislative system of the utilization of reclaimed water,especially to introduce special legislation on the utilization of urban reclaimed water.At present,local governments in China are actively carrying out the legislation of reclaimed water and introducing laws and regulations to regulate the utilization of reclaimed water.Under the local beneficial exploration,it lays a solid foundation for the special legislation of urban renewable water utilization in China.Therefore,the author elaborates the current situation of legislation on the utilization of urban reclaimed water in China,and then emphatically analyzes the existing problems in the legislation on the utilization of urban reclaimed water in China.The existing laws and regulations are too principled and not operable.Low legal rank and lack of system;The penal provisions need to be improved and the public participation is insufficient.Local legislation has different provisions;Overlapping management departments and unclear statutory responsibilities;The system related to the utilization of reclaimed water is not sound;Lack of guarantee mechanism for the utilization of reclaimed water.Accordingly,the following Suggestions are put forward,that is,to change the legislative idea and make special legislation;Refining the ambiguity of existing legal provisions;To establish andimprove the legal system for the utilization of reclaimed water;Improve the relevant legislation,improve the intensity of punishment;Establish public participation mechanisms.At the local level,improve local legislation and enhance operability;Clear management subject and its duty in legislation;Improving the relevant systems in local legislation;Perfect safeguard mechanism.Suggestions for the legislation of urban reclaimed water utilization in China.
