Research On The Legal Guarantee Of The Development Of Wind Power Industry Behind The Phenomenon Of Abandoning Wind Power In China

Vigorously developing clean energy has become the general trend of energy restructuring around the world.The development and utilization of clean energy can not only replace traditional fossil energy to solve the energy bottleneck of all countries,especially developed countries,but also reduce environmental pollution,reduce the pressure to deal with international climate change,and achieve a win-win situation of economic and social development and energy structure optimization.Our country is a much less coal gas boundary,with coal as the main body in the energy state,as to build a well-off society in an all-round way into the run-off stage,to maintain rapid growth in the economy must have a lot of energy as a support,must vigorously develop clean energy and use clean energy to gradually replace the traditional fossil energy,the goal to build a well-off society in an all-round way to realize the effort to reduce environmental pollution at the same time,deliver on the promises of our country to cope with the international climate change issues,take on the responsibility as a world power in our country."Renewable energy law","the overall ecological civilization system reform plan," "much starker choices-and graver consequences-in" energy planning "and so on a series of laws and regulations and related policies promote the development of China's clean energy,wind power industry as an important part of the clean energy industry in China,in the late 1990 s began to flourish,the renewable energy law in 2006 after the" blowout "stage of development,China's wind power capacity in 2010 surpassed the United States,to become the world's number one in the world.However,behind the rapid development of China's wind power industry,the phenomenon of abandoning wind power began to appear in 2010,which is still very serious.From 2010 to 2016,the electricity loss caused by abandoning wind power in the wind power industry was about 150 billion KWH.Although the phenomenon of abandoning wind power in China has improved after 2017,the situation is still very grim.It is estimated that the electricity loss caused by abandoning wind power in China from 2010 to now is about 120 billion yuan.There are complex reasons behind the phenomenon of abandoning wind power in China,including technical reasons,policy reasons and legal reasons,etc.The author focuses on analyzing the legal reasons in this paper.First of all,the author comprehensively analyzes the influence of wind power abandonment behind the development of the wind power industry.After analyzing the current laws and regulations of China's wind power industry,the author finds that thelegal reasons behind the phenomenon of abandoning wind power include the defects in legislation and law enforcement.Based on relevant legal theories,the author puts forward Suggestions for improving the above legal defects.The author believes that China should perfect the legal system of wind power industry,establish mandatory rules,perfect specific legal system and construct diversified energy dispute resolution mechanism.In the aspect of law enforcement,the responsibilities of energy management agencies should be clarified,unified supervision mode should be established,and administrative law enforcement behaviors should be regulated.Comprehensive legislation and law enforcement to consider the sound development of China's wind power industry advice.
