Study On China’s Legislation Of Wind Power

Since the last century, the energy crisis and environmental problems are intensifying around the world. so countries have begun to develop new energy sources, and wind energy development is the rapidest. For China, the wind power industry is one of the highest marketisation energy of renewable energy. The government has promulgated the " Renewable Energy Law "which is the core of a series of laws to promote the development of China’s wind power industry, and the total target system, tariff system, the Renewable Portfolio Standard and the economic incentive system. Such legal system has played an impotant role in promoting the development of China’s wind power industry. However, this law system still has some problems, Such as lower legal rank; facilities unsound; the total target system and tariff system can not work. Thus, although the installed capacity of China is living in the world now, can only be called "Wind TVU country" instead of" wind power country." It is time to solve the law problems:first, perfect relevant laws, and develop specific legislation; second, perfect specific legal system and tariff system, make the total target system to work; third, improve the systems of tax incentives and subsidies to further strengthen the economic incentive system. Finding the existing problems of the legal system, through analyze status of the wind power industry and legal promoting system. Writer try to build a legal system which can promote sustainable development of wind power, which is also the purpose of this paper.
