A Study On The Judicial Functions Of The Provincial Governors Of Tang Dynasty

There were more than 300 provinces in the Tang Dynasty,and each province had a provincial governor in charge of government affairs.The provincial governor of the Tang Dynasty,who commanded the political,economic,cultural,military and rule of law In their own territory,was the most numerous senior civilian officer in the Tang Dynasty,with noble status and great powers.Du Mu said when he asked to go out to serve as an assassin," The importance of provincial governors is that they can kill people and have a good salary." It can be seen that the status and powers of the provincial governor are very strong.Tang Liu Dian prescribes the duties of provincial governors.According to the records of Tang Shu and other historical materials,the functions of Provincial governors include the following aspects:taxation,rule of law,infrastructure,education,and leading the army to resist aggression and protect the people.Judicial functions play an important role in these functions of provincial governors.This paper makes a broad understanding of the judicial functions of the provincial governors in Tang Dynasty,and divides them into four aspects: the judicial trial functions of the provincial governors,the judicial execution functions of the provincial governors,the judicial supervision functions of the provincial governors,and the judicial governance functions of the provincial governors.After having a preliminary understanding of the judicial function of the provincial governor,this paper will analyze the characteristics of the provincial governor in performing the judicial function,including five main characteristics: In practice,it mostly manifests itself as qing and strictness.,paying attention to filial piety,In order to grant grace,a case is not adjudicated in accordance with the law,being closely related to the region and the times,and judicial professionalism is not the necessary condition for their appointment.Finally,it evaluates the judicial function of the provincial governor of Tang Dynasty.
