Research On The Historical Rights Of The South China Sea Islands And Their Sea Areas

Since ancient times,the South China Sea Islands and their sea areas have been China's inherent territory.China's sovereignty over the South China Sea Islands is not only based on historical facts,but also has international legal basis,including international treaties,international customary laws,legal principles,judicial precedents,relevant bilateral treaties and multilateral treaties,which established China's Sovereignty.The "historical rights"advocated by China are compatible with the provisions of the United Nations Convention on the Law of the Sea;according to the internationally recognized principle of estoppel,other disputed countries in the South China Sea have recognized China's sovereignty over the South China Sea Islands;The general legal principles of international law such as the Intertemporal Law and related judicial precedents also support China's sovereignty over the South China Sea Islands.However,despite China's unquestionable historical and legal basis for the territorial sovereignty and maritime rights of the South China Sea Islands,due to the insufficient control of the South China Sea region,especially the controversial islands and reefs and waters,China's maintenance of the rights and interests of the South China Sea has been passive.Based on this background,the thesis conducts a survey of the fishermen in Tammen,and takes the fishermen of Tanmen as the main body,based on historical rights,studies and analyzes the historical rights of the South China Sea islands and their sea areas.Prove China's historical rights to the islands of the South China Sea,and propose corresponding countermeasures and suggestions.In order to achieve the research goals,the author used a variety of research methods such as literature analysis,empirical investigation,interviews,and in-depth interviews,and comprehensively considered and summarized,the overview of Tanmen Town,the history of fisheries development and the basic situation of fishermen.Through research,the author found that the Tammen fishermen were the first to develop the South China Sea and they have long lived and produced in the South China Sea Islands.Their exploration and cultivation of the South China Sea Islands has never been interrupted in history.Such an objective fact itself is a powerful proof of China's historical rights in the South China Sea Islands.The historical rights are a powerful basis for China to resolve disputes in the South China Sea Islands.Taking the representative Tammen fishermen as the entry point,through the study of their discovery and cultivation of the South China Sea Islands,we can further prove our country's historical rights in the sea area.In view of the existing problems,the author proposes countermeasures and suggestions from strengthening the fishing activities in the South China Sea,encouraging fishennen to go out to sea,continuing to support the Tanmen fishery,and government policy guidance and support.I hope these could provide useful help to solve the South China sea island dispute issues.
