A Comparative Study On The Local Legislation On The Protection Of Cultural Relics In China

Cultural relics,as an important part of cultural heritage,are the realistic carrier of national memory,and are also important resources for social and economic development.On October 18,2017,General Secretary Xi Jinping stressed in his report to the 19 th National Congress of the Communist Party of China that he would strengthen cultural self-confidence and promote the prosperity of socialist culture.To promote the development of cultural undertakings and cultural industries,it is necessary to strengthen the conservation and utilization of cultural relics and the preservation and inheritance of cultural heritage.On November 4,2017,in order to implement General Secretary Xi Jinping's new era of China,At its thirtieth meeting,the standing Committee of the Twelfth National people's Congress decided to amend the Law on the Protection of Cultural relics of the people's Republic of China and increase the protection of cultural relics and ancient buildings.So far,our country has initially formed a multi-level legal protection system for cultural relics based on the Constitution,with the "Cultural relics Protection Law" as the main body,and with numerous separate laws and regulations and local government regulations as branches,among which,The local legislation on the protection of cultural relics has made remarkable achievements,which has a profound influence on the cause of cultural relic protection,but it also exposes many problems,which is worthy of our deep thinking.Ben The article is divided into five parts,the status of local legislation on the protection of cultural relics in China is combed and analyzed.Part 1: This part introduces the related concepts of cultural relic and cultural relic protection,expounds the concept,classification and characteristics of cultural relic,and combs the relevant legal principles of cultural relic protection.Part 2:This part summarizes the activities of local legislation on the protection of cultural relics in our country.Firstly,it reviews and combs the process of legislation of cultural relic protection in China,and then defines the concept of local legislation.Therefore,the concept of local legislation for cultural relics protection and the principles that should be followed by legislative activities are introduced.Part 3:This part mainly compares and analyzes the current effective local legislative achievements on the protection of cultural relics in our country.Through the comparison between macro and micro aspects,it makes a comparison of thenumber of local legislation on cultural relic protection,the composition of legislation,and the nomenclature norm.Three kinds of cultural relic different protection measures,special cultural relic protection system or standard several aspects have carried on the contrast and the analysis.Part 4:Through the comparative analysis of the third part and the combing of the achievements of the local legislation on the protection of cultural relics,we find two kinds of problems existing in the current local legislation on the protection of cultural relics,one is the problems existing in the legislative model,One is the problem in the content of legislation.Part 5:To the local legislation on the protection of cultural relics issues arising from the legislative recommendations.
