Study On Legal Protection Of Intellectual Property Rights In Traditional Handicrafts In China

The traditional handicraft is the essence of the culture handed down in the history of our country.Although it has gradually lost part of the survival soil under the impact of the modern way of life,it should not be ignored that the traditional handicraft still has a very high artistic value.Economic value and humanistic value.Moreover,the protection and inheritance of traditional handicraft are also related to national cultural security,regional economic security,group rights and interests and individual rights andinterestsin this situation,it is of great research value and practical significance to study the intellectual property legal protection of traditional handicraft.The legislation of protecting traditional handicraft in our country is scattered,and most of them are administrative laws and regulations.Civil protection,especially intellectual property protection,is basically absent,mainly administrative protection.Under this background,this paper,referring to foreign legislation and combining the actual situation of our country,puts forward some shallow opinions on how to protect traditional handicraft intellectual property effectively,in order to benefit our country's legislation and judicial practice.At the same time,we should strengthen the awareness of the public to protect the intangible cultural heritage,and then protect and promote the development of national traditional culture and world cultural diversity.The protection of traditional handicrafts is obviously beyond the scope of the existing intellectual property system,but it is inextricably linked with it.This paper discusses the feasibility of the legal protection of intellectual property rights of traditional handicrafts.This paper analyzes the present situation of intellectual property protection of traditional handicrafts in China,draws lessons from the experiences of foreign countries,and puts forward some suggestions for perfecting the legal protection of intellectual property rights of traditional handicrafts in China.At the present stage,the traditional handicrafts will be brought into the current intellectual property system,with the use of patents,trademarks,copyrights and anti-unfair competition systems for comprehensive protection.At the same time,by reforming and adjusting the existing intellectual property system or innovating the system,we can eliminate the factors that do not protect the traditional handicraft.In addition,we will perfect the legal protection system of traditional handicraft and its concept of "non-material cultural heritage",and shape a legal protection environment conducive to the inheritance and development of traditional handicraft.In addition,we will perfect the legal protection system of traditional handicraft and its concept of "non-material cultural heritage",and shape a legal protection environment conducive to the inheritance and development of traditional handicraft.
