Research On The Construction Of The Law System Within The Party Under The Comparative Perspective

Under the logic of "governing the country must first govern the party,governing the party must be strict,strict must have legal system,and legal system must be complete",the CPC introduced the "systematic" thinking into the process of building the Party's internal laws and regulations.In October 2014,in his speech at the Fourth Plenary Session of the Eighteenth Central Committee,General Secretary Xi Jinping put forward for the first time the realistic proposition of "forming a perfect system of laws and regulations within the Party".The construction of inner-party laws and regulations system is of positive significance for consolidating the foundation of all-round strict governance of the party system,promoting the modernization of the national governance system and governance capacity,and improving the development of inner-party laws and regulations.The systematic construction of the socialist legal system with Chinese characteristics started early.At present,it has basically realized the requirements of the consistency of objectives and tasks,the integrity of the overall system,the unity of substance and content,and the hierarchy of the formal structure,and has accumulated a lot of valuable experience in practice.Based on the fact that the systematic technology of rule of law has no value,this paper aims to compare the inner-party legal system with the socialist legal system with Chinese characteristics,and to find out the inner-party legal system by referring to the "four basic principles" condensed in the process of building the socialist legal system with Chinese characteristics,the important position of the established legal principles and the orderly structure of the "horizontal" and "vertical" formed in the process of building the legal system with Chinese characteristics.The experience that can be used for reference in the construction of the systematization of laws and regulations can provide reference for the construction of the systematization of laws and regulations within the Party.
