Research On Legal Issues Of New Broadcasting Right Of Sports Events

The times are advancing,new media technologies and network technologies are constantly evolving,and the cause of sports events has also exploded.As a result,more and more people joined the sports event broadcast industry,which enabled the industry to develop rapidly.At the same time,related disputes are constantly emerging.In the case that China's copyright law has not yet perfected the protection of the rights related to sports events,a large number of disputes that need to be resolved and problems that are lack of legal basis will lead to complicated and cumbersome dispute resolution.Therefore,the legal protection of the broadcast behavior of sports events is imminent,of.This paper aims at the legal protection of new media broadcasts in sports events.It uses literature research method,theoretical analysis method,case analysis method and comparative analysis method.Based on the existing sports event broadcast theory,it demonstrates the legal nature of the broadcasting rights of sports events.The main body of this article is divided into four parts.The first chapter is an overview of the new media broadcasting rights of sports events.This chapter mainly studies the definition of new media broadcasting rights in sports events;details the subject,object and rights content;analyzes new media.The progress and defect of the broadcast.The second chapter is mainly about the legal attribute of the new media broadcasting rights of sports events.In this chapter,the rights of sports events are mainly classified into the right to broadcast sports events and the broadcasting rights of sports events,and the theory of extraterritorial and domestic doctrines Angle studies to clarify the nature of the right to broadcast sports events.The third chapter is mainly about the infringement and relief of the new media broadcasting rights of sports events.Firstly,it summarizes the infringements of the new media broadcasting rights of sports events,and expounds them one by one,and then introduces the constituent elements of infringement and the existing remedies for infringement.The fourth chapter is the dilemma and perfection suggestions for the infringement relief of new media broadcasting rights in sports events.On the basis of analyzing the existing dilemmas,it is clear about the nature;standardizing contracts;improving copyright law;establishing joint law enforcement mechanism;strengthening industry self-discipline;Suggestions are given from the perspective of technical means.I hope to elaborate the related issues of the new media broadcasting right of sports events,clarify the nature,narrate the current situation,find out the problems,and put forward personal suggestions,which can provide suggestions for the protection of the new media broadcasting right of sports events in China,and build the legal protection system of the relevant industries in China.
