Since the 1980s,China's sports industry has experienced a spurt of development,and the cost of broadcasting for sports events has also risen,and the litigation related to the rights to broadcast sports events has also increased significantly.However,due to the lack of clear regulations on the broadcasting rights of sports events in China's existing laws,the judgments on the rights of broadcasting sports rights in judicial practice vary greatly,and it is difficult to protect the legitimate interests of relevant rights holders.As for the academic circles,how should we define the right and its legal attributes,as well as the path through which the right to broadcast sports rights should be legally protected,is highly controversial.All of these problems indicate that there is a strong urgency to study the right to broadcast sports events.This paper is divided into four parts to study the legal protection of the right to broadcast sports events.The first part,expounds the basic theory of the broadcasting rights of sports events,including the history of its development,the analysis of related concepts,and finally the concept of the right to broadcast sports rights and the legal nature.The second part is a detailed review of the current legislative and judicial cases related to the broadcasting rights of sports events in China,paving the way for questions and analysis.The third part analyzes the problems existing in the legal protection of the broadcasting rights of sports events.It points out that the crux of the problem is that the object that does not accurately define the broadcasting rights of sports events,that is,the basic attributes of sports events,and the sports events should be attributed to the works."Analyze the analysis.The forth part,through the above analysis,analyzes the loopholes in the protection of the rights of sports events in China by the Copyright Law and the Anti-Unfair Competition Law and puts forward suggestions for improvement.At the same time,it is pointed out that it is completely inadequate to protect the broadcasting rights of sports events only through legislation.It is also necessary to cooperate and work together in many aspects.
