Research On The Legal Issues Of Subsidy Rules For Trade In Services

With the global economy becoming more and more service-oriented,service trade has gradually become the focus of modern international economy and trade.Service trade plays an extremely important role in promoting the rapid growth of global economy.However,as the main means for most countries to support their own service industries,service trade subsidy measures are not yet subject to a complete rule system,except for those involved in the GATS.Therefore,under the framework of WTO,to accelerate the establishment and improvement of international service trade subsidy rules is the cornerstone of the rapid and efficient development of global service trade,and it is also the problem that China should solve in response to the existing opportunities and challenges.The article consists of five chapters.The first chapter mainly introduces the relevant concepts of international service trade and service trade subsidy,and focuses on the historical negotiation process related to the definition of service trade subsidy,which lays a foundation for the definition of service trade subsidy in the following paragraphs.The second chapter discusses the specific provisions related to service trade subsidy in GATS,and studies the service trade subsidy rules under GATS from the three perspectives of "similar analysis",the principle provisions of GATS on service compliance and the dispute settlement methods of service trade subsidy.The third chapter looks at the development of multilateral rules of international service trade subsidies briefly reviews and sorts out the service trade subsidies negotiations other than GATS,and puts forward the development trend of multilateral rules of service trade subsidies in the future based on the analysis of the necessity of improving multilateral rules of international service trade subsidies.The fourth chapter mainly analyzes the current situation of China's service trade and service trade subsidy system,and sorts out China's existing policies and legislation related to service trade subsidy through a large number of official data,so as to put forward the existing problems of China's service trade subsidy.On the basis of the foregoing,the last chapter analyzes the issues to be considered in the future negotiations of themultilateral rules of international trade in services subsidies,and provides some constructive Suggestions for improving the system of international trade in services subsidies.In the conclusion,the author puts forward some Suggestions on the problems of China's service trade subsidy system.The innovation of this paper is that it carefully sorts out and summarizes the relevant negotiation contents of service trade subsidy rules,which lays a foundation for studying the current situation and future trend of service trade subsidy negotiation and avoids generalizing.At the same time,when analyzing the current situation of China's service trade subsidy system,it also summarizes and sorts out a large number of laws and regulations,government official documents and policy interpretation,so as to point out the problems in China's service trade subsidy system intuitively and make the conclusion more convincing.However,due to the limited level and energy,when collecting information related to the international service trade subsidies have its gaps and to a certain extent can lead to correlation analysis respectively,moreover,because of the international official organization related agreement with the content is various,not trying to comb and analysis,need further study in the future.
