Anti-subsidy Law System Research On International Trade In Services

With the rapid development of International trade in services, it becomes animportant power of economic growth in international trade. Along with the globalindustrial upgrading, service industry becomes the key part of the internationalindustrial instead of manufacturing; there is huge capacity for development of globalservice trade. However, Compared with the traditional international trade in goods, theliberalization in services is still in a low level. The MTS (Multilateral Trading System)is good for regularization of the liberalization of international trade in services, but thesystem’s design is very bad for the opening of international service trade market.Currently, the WTO members make use of subsidy policy to develop domestic servicetrade and improve its international competitiveness. The countervailing system forInternational service trade is still in the stage of negotiation for necessity of legal rules,the basic system is also unformed.Based on the above background, this paper will use four chapters to discuss theproblem of subsidy in international service trade. The first part introduces the relatedconcepts of the international trade in services, such as service, international services,subsidies and countervailing; the last section will discuss goods trade and service tradecountervailing anti-subsidy, the similarities and differences between the trade in goodsand services, and the transformation between them; In part two, it discusses whether theexisting GATS specification can constraint service trade subsidies and countervailing,the reasons of support and against to develop service trade subsidies and countervailingdisciplinary to expound the necessity of building service trade countervailing. In thethird part, it discusses issues during constructing countervailing rules of service trade. Itmainly analyses construction subsidies and countervailing in service trade withdefinition and classification of subsidies and countervailing, and the relief way in the SCM, then discusses issues of how to define and classify and how to choose the reliefway for trade in services during construction of countervailing policy for service trade.At Last, it will focus on revelations and recommendations for China’s subsidies andcountervailing policy of service trade. It analyzes current overview status of China’sservice industry and legislation state for subsidies and countervailing measures inservice trade. It also proposes some advice for insufficient.
