Abortion is not a new topic at home and abroad.Abortion is related to women's rights,family happiness,social order and even the future of the nation.Abortion is a complex issue involving ethics,morality,politics,etc.The abortion judgment and related legislation are rooted in a country's politics,economy,history,and culture.The attitudes of Chinese and Western societies to abortion vary widely.Limiting the extent of abortion will have different social effects.The improvement of women's status,the advancement of medical technology and economic abundance have made foreign abortion policies liberalized.China's birth policy has produced related abortion problems,mainly forced abortion and gender-selective abortion.Facing the situation of population aging and gender imbalance,how to formulate a fertility policy suitable for our society has become an important issue based on China's national conditions.Conflicts between different rights are inevitable.The order of basic rights has an important influence on the abortion policy.Exploring the order of basic rights can better deal with abortion.In addition to the introduction,the article is divided into four parts.The first part shows the order of basic rights in the abortion case.The judgment of the abortion case reflects the change of the order of the basic rights order.The second part analyzes the influencing factors of the order of the basic rights order,including the constitutional core values and constitutional norms,historical religion,economic population,and the influence of international law.The third part introduces the basic order of rights displayed in China's birth policy.Due to the economic foundation and cultural tradition,the basic rights order has priority to the right to subsistence,and the related birth policy has caused corresponding social problems.Due to economic development and social changes,combined with China's traditional culture and international law,in the case of an aging population and an imbalance of gender ratios,the order of basic rights should be changed to give priority to women's self-determination.The conclusion of the fourth part shows that under the guidance of the basic order of rights,women's rights to abortion should be fully guaranteed.Through the elaboration of the basic rights order in this paper,it is expected to trigger more people's attention and thinking on abortion,thus achieving the balanced development of reproductive rights and other rights.
