Research On Legal Issues In Joint Development Of Marine Boundary Tourism Resources

Joint development is a type of interim arrangement under the “United Nations Convention on the Law of the Sea”.As a new cooperation mechanism between countries,it's of momentous practical significance.With the sophisticated international cooperation of oil and gas resources and fishery resources,tourism resources,in a form of low-sensitivity joint development,have also gradually been highly recognized by the international community.The joint development of tourism resources is a new attempt of international cooperation model.It not only brings very considerable economic benefits to China and neighboring countries,but also promotes cultural exchanges amoung nations.This conforms to China's “The Belt and Road Initiative”,and forms a good cultural integration situation.It also fully reflects the “Community of Shared Future for Mankind”proposed by General Secretary Xi Jinping,adapting to the new changes in economic globalization.However,since the joint development of tourism resources is only an effective consensus reached among concerned nations and lacks specific legislative practice,it is still at the stage of exploration.Therefore,in future practice,we may face some international law issues remained to be solved,such as the choice of the joint development of tourism resources modes,the jurisdictions of travel disputes,and environmental liabilities.Due to the limited space of the article,in this paper,the author mainly discusses these international law issues that may arise in the joint development of tourism resources between China and neighboring countries.Only by predicting and perfecting these issues as early as possible can we ensure the smooth development of the joint development activities of marine boundary tourism resources.This paper uses a variety of research methods such as literature research,comparative analysis and interdisciplinary research.Based on a large number of domestic and foreign materials of the joint development of marine boundary tourism resources,the paper makes an in-depth analysis on international law issues that may arise related to the initial stage of joint development of marine boundary tourism resources.The first part of the paper introduces the purpose and significance of the topic,research status and development trends at home and abroad,research methods and innovations.The second part introduces the basic issues related to the joint development of marine boundary tourism resources.The third part introduces the basic principles and legal basis for the joint development of marine boundary tourism resources.The fourth part makes a predictive analysis of the three international law issues that may arise in the future development of tourism resources by analyzing and summarizing mature international joint development cases.The fifth part is the key part of this research topic: The discussion and research on the issues related to the joint development of marine boundary tourism resources in the first four parts are the theoretical preparations for China's future practice of participation in the joint development of marine boundary tourism resources.After analyzing the potential issues,it has summarized rational proposals such as prioritizing agency system development model,affirming the primary jurisdiction of the courts of tourists' accommodation,and establishing the regime of environmental liabilities in tourism activities from the legal and institutional perspectives.
