Legal Research On The Division Of The Powers To Endowment Insurance And The Responsibility Of Expenditure Between Central And Local Governments

Reasonable division of government power and expenditure responsibilities between central and local governments,and rationalization of fiscal and taxation relations between governments is an inevitable requirement for establishing a modern fiscal system and realizing the modernization of government governance systems and governance capabilities.As a central public service area,the division of basic endowment insurance's administrative power and expenditure responsibility is of great significance for the protection of social relief rights such as pension security,the implementation of the vertical power allocation between central and local governments,and the guidance of the division of other administrative rights in the public service area.However,in the actual operation of basic endowment insurance in China,there are still some problems to be solved,such as the principle of the division of administrative right and expenditure responsibility stipulated by law,the irrationality of the division of administrative right and expenditure responsibility,and the imbalance in the operation of administrative right and expenditure responsibility.Modern financial regime system,under the control of the information cost and implementation cost of government affairs,the central government and local governments must needs to allocate the powers and responsibilities of the longitudinal division,only the central government accountability between matter and clear,clear relationship,to avoid the excessive centralization,local government abuses and weak financial resources of local government,which relies heavily on the central government both for civil rights and government power configuration.This article in the governance and expenditure responsibility concept,clear endowment insurance relationship on the basis of the endowment insurance powers between the central government and spending,liability principle,the standard of legal theory analysis,combined with the constitution and the social security act as the backbone of all legal norms and normative documents of the state council as the main body of the administrative rules and regulations of normative analysis,found that the central government of endowment insurance between the governance and expenditure responsibility norms and realistic problems.Based on this,the author puts forward some specific Suggestions on the division of administrative power and expenditure responsibility of pension insurance between central and local governments.Secondly,we should enrich the local financial power and improve the financial transfer payment system.Finally,it is necessary to improve the consultation mechanism for the division of governmental power and expenditure responsibility and establish the procedural guarantee for the allocation of intergovernmental power.Finally,the intergovernmental fiscal relationship with "clear responsibilities,coordinated financial resources and regional balance" will be established.
