The planned construction land index system is the product of public ownership of socialist land in China.The land market is strictly controlled by the government.The state organs regulate the use of land by formulating the overall plan of land use and the annual plan of land use.By using indicators and zoning,let the constructive land converted into quantifiable indicators for the layout of urban and rural areas then performing top-down control to mitigate conflicts between urban development and farmland protection.The development of construction land management will be accompanied by the planned construction land index system.In the development of the planned construction land index system,China has experienced the initial exploration and control stage,the initial development stage of"special supply on demand",the growth stage of legalization of land management,and the mature development stage of strict management and control.The control over the construction land is constantly tightened,and the planned features are remarkable.The theoretical bases for the existence of the planned construction land index system are the measurement of institutional interests,the appropriate intervention by the government,and the public ownership of socialist land.Therefore,the planned construction land index system has its rationality.However,with the continuous advancement of urbanization,the demand for construction land has become more and more vigorous,local governments have gradually broken through the index restrictions,and the planned construction land index system is facing a real dilemma.There are some principal problems in it.The three issues including"the departmental government positioning bias","the planned construction land index decomposition and distribution","reasonable and planned construction land index and reality are not high".In the allocation of construction land index resources,the specific performance is as follows:First,the excessive intervention of the central government's main body leads to the rigidization of the construction land index,and there is a problem of"rigid rigidity,insufficient flexibility"and"planning indicators"about construction land index that are difficult to meet the actual needs.Second,the lack of responsibility of the local government has led to confusion in the use of construction land indicators.The main manifestations are the frequent occurrence of land violations and the government's power to seek rent.Third,the decomposition of the construction land index is unreasonable.The main performance is that the"planned indicators"are unreasonably based on unreasonable distribution and construction land use indicators in urban and rural areas.Fourth,the planned land use indicators are not well connected with the land use master planning,urban and rural planning,national economic and social development planning,environmental protection planning and other related planning.The process of multi-regulation and rule-of-law are relatively lagging behind that lead to the phenomenon of planning fighting'lacks a unified legislative documents.Fifth,the public participation in the construction of land planning is not effective.The rigidity of the operation of the planned construction land indicator system is related to the lack of public consultation in the process of preparation.The legislative status of public participation in China is only a slogan clause,and the statutory procedures and methods of public participation are not specified.Moreover,the public's awareness of participation is weak,their professional ability is weak,and they lack the guidance of relevant organizational mechanisms.The above-mentioned problems affect the government's administrative quota allocation and construction land index,which weakens the efficiency of the government's macro-control of land supply.At present,under the premise of not violating the planned construction land index system,all localities have creatively explored the market-oriented tradable construction land index system,and optimized the allocation of construction land index resources through market-based means.It is particularly necessary to actively promote the transformation of the planned construction land index system in order to make the administrative allocation of construction land quotas compatible with the supply and demand of the land market,and to coordinate the intrinsic link between the planned construction land index system and the market-oriented construction land index system.In view of the problems in the operation process of the planned construction land index system,this paper puts forward some suggestions for improvement:First,the government implements the management mode of'plan management?total control".We will change the"incremental regulation"model that is prone to land use efficiency in the past,scientifically and rationally set the upper limit of the total amount of land for construction,and promote the comprehensive utilization of land functions.Second,the government implemented the dynamic adjustment of the"differentiated indicator supply policy"and formed a dual-track parallel land supply structure with"command allocation indicators for public welfare construction projects and market transaction indicators for business construction projects".Third,in the process of applying scientifically allocated land use indicators,the government should control the government's control over land use quotas,become a service-oriented government and a government ruled by law,rationally implements responsible government construction.Fourth,the government should carry out the"multi-regulation"rule of law reform,promote the rational distribution of construction land indicators;establish and improve the public participation system,balance the conflict of interests between rights and rights.
