Research On Prevention Of The Corruption Crimes Of Chinese Private Entrepreneurs

The rapid development of private enterprises has benefits of stimulating market,providing jobs,increasing income of residents.It also plays an inestimable role in improving the national economy.However,behind the appearance of prosperity lies the problem of corruption and crime of private entrepreneurs in our country,which seriously affects the development of the national economy and undermines the bottom line of the law.This is contrary to the original intention of private enterprises and private entrepreneurs.Therefore,we must pay attention to the risk prevention of private entrepreneurs' crimes,so that civil entrepreneurs can legally operate in accordance with the law,and then achieve the goal of promoting national economic development.Based on this,this paper takes criminology as a starting point and uses empirical research methods to analyze the causes of crime from many perspectives and proposes a series of concrete preventive solutions in order to prevent the risk of corruption crime of private entrepreneurs in China.By collating the cases from 2016 to 2018 and analyzing the current situation,it can be found that the reasons for the corruption crimes of private entrepreneurs can mainly be classified into four categories: First,on the level of private entrepreneurs,low level of education and management ability,the concept of backward fluke.Second,on the level of private enterprises,corporate governance structure is deficient,internal rules and regulations are not perfect,and the unhealthy operating environment of some industries leads to the occurrence of corruption crimes.Third,on the level of government,there are too much attention to political performance,market intervention means unreasonable problems.Fourth,on the level of legal,laws and regulations are not perfect,the lack of strict,targeted means of governance,and sentencing imbalance leads to corruption.As the saying goes,"it takes two to make a quarrel",the four jointly cause the occurrence of corruption crimes committed by private entrepreneurs.Therefore,in order to solve the problem of corruption encountered by private entrepreneurs and make better use of the role of private entrepreneurs,the author believes that the following measures can be taken to prevent and control risks: First,private entrepreneurs should take the initiative to prevent the occurrence of corruption and subjectively establish the concept of the rule of law.They should also objectively enrich their knowledge to standardize management behavior.Secondly,the private enterprises should conduct the internal prevention,actively build the enterprise culture,innovate management way and improve the internal governance structure based on the law.Third,the government implements supplementary prevention from the outside,implements government reform requirements,consolidates its own management functions,and innovates administrative means to create a "serviceoriented government." Finally,governors should conduct the comprehensive prevention of judicial activities which runs through legislation,the judiciary and law enforcement.They should also improve the content of legislation,strengthen the functions of judicial organs,and regulate law enforcement activities.
