In Thomson period in our country there is "no" of investors vibration of tradition,this is also considered a prototype of charity started in our country,the development of charity career in China with our development related to the soil,suitable for charity in China is a country attaches great importance to the idea of "benevolence",heavy harmony and moral codes of the country,so the harmony between people and taking dangerous poor tradition is the foundation of philanthropy can take root in China.The society is progressing and the philanthropy is also developing.Today,we can call it "we media" era,which is directly related to the rapid development of the Internet.Philanthropy is also quietly changing in such a background,charity "Internet + charity",that is,network,compared with the traditional philanthropy,charity beyond the timeliness and regional network,the natural advantages make donation is gradually accepted by the public network,but any emerging things if there is a lack of dedicated to the regulation of bad feelings,so for this is only a flash in the pan of fine things,because of its lack of "living water" flow nourish,destined to the development of the long term.That for China's online donation,its healthy development is the law of rules and regulations,and the law is needed to take "shrink",that is to say,this law is specifically for online giving law rather than "side-door law",in the legal regulation of charity in China and many,but for online giving itself law did not,that is donated in the rapid development of network in China,and the problem is uneven,but we have a similar rules only depend on laws to regulate online donation,it is not appropriate,also is not comprehensive.For this reason,the author also mentioned the existence of relevant problems in the elaboration of the paper,and put forward some targeted Suggestions,in order to look forward to the development of China's network donation toward a more standardized direction.This paper mainly studies the development status of network donation,so as to summarize the existing problems of network donation in China,and to further analyze and regulate the problems.This paper is developed from five aspects.The first part elaborates the background and significance of this paper,as well as the research status,research ideas andmethods at home and abroad,as well as the innovation points of this paper.It is pointed out that the legal relationship of the main body involved in the network donation is relatively complex,but as a new thing,the network donation is worth studying in many aspects,which will pave the way for the following paper.The second part mainly analyzes and summarizes the meaning of network donation,the difference between network donation and traditional donation,as well as the origin,development and current situation of network donation.At the same time,it elaborates the legal attribute of network donation,and concludes that network donation belongs to private benefit donation,and explains the reasons.The third part of the network donation involved in the legal relationship between the parties to elaborate.The author analyzes the legal relationship between the network donor and the donor,the network donor and the network donation platform,the network donor and the beneficiary,and the network donation platform and the network donor respectively,and explains the viewpoints agreed by the author.After the analysis of the legal relationship between the network donors,the rights and obligations of the network donors are expounded.The fourth and fifth parts mainly analyze the current legislation situation and existing legal problems of network donation in China,and propose the legislative model of network donation in China,as well as corresponding legal improvement measures for the existing problems in network donation.
