Research On Legal Issues Of Online Donation Crowdfunding Platform

With the rapid development of mobile payment technology,online donation crowdfunding platforms,such as "Fun in Funding" and "Shui Di Chou",which provide services for personal online donations,are gradually becoming well known to the public.The public uses these platforms to initiate personal help and plays an important role in improving the social help mechanism and maintaining social stability.However,since the donation crowdfunding activities carried out through the online donation crowdfunding platform are not within the scope of the charitable activities stipulated in China’s "Charity Law",the legal status of the platform has formed a different understanding in the academic circles.There are also many legal problems in the operation of the platform.For example,the eligibility criteria of the project sponsor are unknown,the platform does not strictly review the project,and the fundraising management and disposal are not standardized,resulting in a serious crisis of trust.In order to regulate the operation of the platform and realize the benign development of the online donation crowdfunding industry,it is necessary to study the legal issues of the online donation crowdfunding platform.With regard to the legal status of the online donation crowdfunding platform,through the analysis of the legal relationship between the platform and the sponsors and donors,it can be positioned as a special intermediary.For the main problems in the operation of the online donation crowdfunding platform,it is necessary to analyze the causes and propose suggestions for improvement from the following aspects:First,improve the legal regulation system of online donation crowdfunding.The "Charity Law" can be amended to include online donation crowdfunding within the scope of the law.A special chapter is set up in the law to make principled provisions.The State Council may issue corresponding implementation rules for further specific provisions.In terms of specific content,it is necessary to clarify the eligible standards of project sponsors,and the rights and obligations and legal responsibilities of online donation crowdfunding platforms.Second,build a government administrative supervision system,strengthen the supervision role of social subjects,and improve the supervision system for the operation of online donation crowdfunding platforms.Third,set up a self-regulatory association for the online donation crowdfunding industry,improve the self-regulation convention,and give play to the complementary role of the self-regulation norms for the online donation crowdfunding industry.
