Study On The Legal Issues Of Public Character Name And Trademark Squatting

With the development of society,people's awareness of trademark protection has been continuously enhanced.Not only are trademarks registered in common forms such as graphics and symbols,but more and more people are beginning to register trademarks with their names,especially the names of public figures.With the increase of name and trademark,there are some cases in practice:some trademark speculators infringe on the public's name right in order to seize the opportunity,and register the trademark of others with the permission of the right holder.The personal rights of public figures.Based on the relevant legal theory,this paper analyzes the problems of public figures' names and trademarks,and combines several cases of infringement of trademarks in the name of public figures in China.On the basis of the induction and analysis of the law of squatting,the paper puts forward specific suggestions on how to improve the legal adjustment of public character name and trademark squatting.As a master's thesis of law,this paper highlights the connection with practice.In the writing of the thesis,pay attention to the collection and analysis of typical cases:the paper focuses on"Mo Yan case","Yu Quan case","Jin Xishan case"and"Qiao Dan case",etc.The case has been sorted out and analyzed from the legal point of view.It is expected that through the study of specific cases,the practical problems in the squatting of public figures will be summarized,and targeted suggestions for perfecting the corresponding legal countermeasures will be proposed.
