Intelligent Connected Vehicles are orienting auto development into a new direction.With vast application potential and enormous commercial value,they allure an increasing number of automakers and tech companies and have received significant recognition and support from various states and governments.Our nation has already made a quantum leap in intelligent drive technology and achieved mass production of these vehicles However,we fall behind developed countries in theoretical knowledge and institutional framework.An intelligent drive system shares control with a human driver,lessens his or her burden of vehicle operation,provides greater road safety,and reduces the chance ofan accident.Nevertheless,no technology,however mature,can guarantee a zero-risk drive.The possibility of accident always looms in today's perplexing roads and traffic environment.Additionally,the novelty and distinctness of Intelligent Connected Vehicles has caused confusion in traditional torts cases.Thus,it is necessary to produce a legal interpretation of Intelligent Connected Vehicles,incorporate it into the traditional torts framework,and promulgate new regulations to govern relevant torts liabilities.The full text is divided into six partsThe first chapter takes three different cases as the starting point,analyzes and thinks about the causes of the accident,and puts forward the possible problems existing in the infringement of Intelligent Connected Vehicles from different angles.The second chapter introduces the definition and classification of Artificial Intelligence and Intelligent Connected Vehicles.It believes that intelligent driving technology belongs to cognitive AI,and adopts SAE International standard to classify Intelligent Connected Vehicles with different levels of automation,specifically studying their civil tort liability.The third chapter studies the civil infringement of the Intelligent Connected Vehicle When the intelligent driving system becomes the new driving subject,there are differences between it and the traditional vehicle infringement in the infringement subject,infringement act,and causal relationship identification.The fourth chapter comprehensively analyzes the limitations of relevant laws based on the particularity of Intelligent Connected Vehicle infringement and the current situation of Intelligent Connected Vehicles infringement policies and regulations in China.The fifth chapter refines the highlights of the system on the basis of combining the legal regulations of the United States,Germany,the United Kingdom and Japan on Intelligent Connected Vehicle tort liability,and sums up the experience that China can learn from in the construction of relevant legal systems.The sixth chapter,on the basis of following the double principles of compensation for damages and guarantee for development,formulates differentiated responsibility rules for Intelligent Connected Vehicles with different levels of automation,and puts forward a guarantee system for the implementation of responsibilities to create a public environment for the operation of the system.
