Research On The Legal Issues Of Old-age Security In Rural Areas

In Premier Li Keqiang's government work report in 2019,"elderly-care"appeared 15 times and became a high-frequency vocabulary,this reflects the concern of the national level for the elderly pension,and attaches importance to the issue of our country's pension.With the development of urban-rural dual structure,the elderly in rural areas show some special needs.Based on the fact that rural economic development lags behind urban areas and education level is lower than urban areas,the legal issue of rural old-age security gradually becomes serious.Most of the provisions in the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly are the universal needs for the elderly throughout the country.There is no special provision for the special needs of the elderly in rural areas,which makes the security of the elderly in rural areas not effectively implemented.Based on the survey of the elderly in rural areas of Y City,Yunnan Province,this paper deeply excavates the problems existing in the implementation of laws and regulations,which include the deviation from the reality,the insufficient old-age security for the elderly,and the low utilization rate of relief mechanism in rural areas of Y City.Emphasis is laid on the special needs of the rural elderly in seeking government pension subsidies due to poverty,enjoying equal rights and interests with the urban elderly in travel preferential policy,and spiritual support.In order to meet the above needs,the author believes that we should do the following:1.Detailed provisions are made on existing laws and regulations to protect the legitimate rights and interests of the elderly in rural areas.2.Optimize and improve the old-age security for rural elderly.3.Constructing the relief mechanism of old-age security for the rural elderly.4.Increase government responsibility to promote the implementation of old-age work.Through the above positive measures,I hope we can build a comfortable zone for the elderly in rural areas.
