Elderly People Rights Protection Law" has enacted more than 10 years. As China's gradual rise of economy in the level and the increasingly improved social security during this period, the living condition of the elderly has a greater degree of improvement.But with the transformation of economy mode and family size, some new problems such as lack of family care, the neglect of spiritual support, etc. have been surfaced. Especially the long-standing policies favoring,resulting in neglect of this group of rural elderly, resulting in protection of the rights of the elderly urban and rural social structure pattern.The protection of the interests of rural elderly must be completed under the joint efforts of state social support,sharing of personal family and community Support, rather than relying solely on individual families and weak protection of land to accomplish this heavy burden.this essay analyzes from the base point of existing living condition of rural elderly,compared to protection of urban elderly, to find the inadequate of rural elderly protection, and the problems reflected.At the same time through analyzing the foreign protecting mode, and domestic protection mode of rights of the elderly to explore innovative research,to find legislative improvements.This article is divided into six chapters.The second chapter defined the basic concepts discussed in this paper.Because the rights of the elderly is a more macro issues, the author here mainly talk about the special group of rural elderly, analyze the problems in the process of protection of their rights. Therefore it is necessary to limit the concept of rural elderly.The third chapter analyzes the Protection of rural elderly on the theoretical foundation and legal basis.This is why it is necessary to write this essay.The forth chapter analyzes the legitimate interests of rural elderly and current conservation status,so as to find a breakthrough for improving the conservation status of rural rights of the elderly.Chapter V includes the analysis of existing problems of Rights and interests protecting of rural elderly.As analyzed in Chapter 4,protection status of rural elderly people can not be optimistic.What it reflects are Gaps in the provisions of the law and weak legal system in the implementation of specific legal regime.The sixth chapter is to analyze the new protecting modes attempt both at home and abroad, to select reasonable place, to be promoted in the protection of rights of the elderly among the rural,attempts to analyze the imperfections of existing legislation under the new mode,in order to provide useful advice for further improving of legislation...
