Research On The Perfection Of Villager Autonomy System In China

Since the implementation of the "Organization Law of the Village Committee" in 1988,villager autonomy has developed rapidly.Entering a new era,the party's 19 th National Congress report proposes a new system of rural governance that combines "autonomy,the rule of law,and the rule of virtue." The village self-government system is the foundation of the rural governance system.The improvement of its system is related to the implementation of the revitalization of rural strategy and the key to rural democratic political construction.This paper briefly expounds the connotation,development process and important role of the villager autonomy system.It is an institutional innovation in the process of rural governance in China and has played a huge role in the rural democratic governance in China.With the implementation of the rural revitalization strategy,there are problems such as conflicts of rights between villagers and autonomous organizations,misplaced duties of villagers' autonomy,unsatisfactory resilience mechanisms for villagers' autonomy,and poor participation of villagers in autonomy.It seriously affects the construction and development of rural grassroots democracy.It is a deeper analysis of the problems existing in the operation of the current villager autonomy system,and it is concluded that there are still some shortcomings in the relevant normative system,power and responsibility division,rights relief and rule of law cultivation mechanism,so as to understand the urgency and importance of the villager autonomy system.Sex.Therefore,this paper has made some discussions on the improvement of the current villager autonomy system.First,we must improve the system of villager autonomy.Under the premise of complying with the relevant provisions of the Constitution on village self-government,to clarify the status of villagers' autonomy and autonomy,it is necessary to formulate a Law on Villager Autonomy to provide specific legal guarantees for the implementation of the villager autonomy system.In addition,it is necessary to improve the supporting laws and regulations to meet the autonomy needs of different rural areas.Finally,we must improve the village rules and regulations,and play a complementary role in the governance of the "soft law." Second,we must clarify the power and responsibility relationship related to village self-government,including clarifying the scope of powers and responsibilities between township governments and village committees,and clarifying the relationship between the two committees at the village level,mutual coordination,mutual cooperation,and mutual restraint.Third,we must improve and play the role of supervision and support,administrative relief and judicial assistance mechanisms for villagers' self-government,and effectively protect the legitimate rights and interests of the majority of villagers.Fourth,we must strengthen the rule of law education for rural cadres and the majority of villagers to ensure the status of the villagers' autonomy.Fifth,we must promote the organic integration of village self-government with the rule of law and the rule of virtue,and promote the villager autonomy system to play its due role in the implementation of the rural revitalization strategy.
