Research On China's Electronic Litigation System

At present,the fourth world science and technology revolution is in the ascendant.Represented by Big Data,artificial intelligence,cloud computing and other high technologies,international technology is booming,which has caused tremendous changes in human society.Along with the popularization of information technology,the production and life of human society has been deeply engraved with the imprint of electronics.The combination of information technology and judicial activities has become the inevitable choice to give full play to the advantages of science and technology.Electronic litigation is an inevitable requirement for adapting to the development of the information age.At present,many countries in the world have explored the system of electronic litigation in different aspects.China is also implementing the supreme people's court's strategic deployment of building the 3.0 version of the people's court informatization,and is facing development opportunities On the basis of exploring the theory of electronic litigation system,combined with the relevant legislation and judicial practice abroad,further analysis of China's legislation and judicial practice,this paper is aimed at putting forward the multi-construction of China's electronic litigation system assumption.This paper is mainly divided into four chapters.The first chapter is an overview of electronic litigation system,including the concept of electronic litigation analysis,description of characteristics,summary of theoretical and practical value.The second chapter is the enlightenment of legislation and practice in other countries.Through the evolution and development of e-litigation system of representative countries in continental law system and Anglo-American law system,it summarizes the enlightenment to China.The third chapter is an overview of the practice of China's electronic litigation system,the current situation of courts around the practice,as well as the existing problems;The fourth chapter is about the pluralistic construction of China's electronic litigation system,and puts forward the idea of perfecting China's electronic litigation system from the Conceptual construction,legislative level and judicial level.
