| The popularity of the Internet has brought unprecedented changes and innovations to human society.While experiencing the convenience of the Internet,it has also suffered from the harmful content of violence,terror,attack,pornography,and false information.The content of illegal information challenges the bottom line of law and morality,and the governance of information content has become an Internet issue closely watched by countries all over the world.Since the18 th National Congress of the Communist Party of China and the 19 th National Congress of the Communist Party of China,we have comprehensively promoted cybersecurity and informationization,and attached great importance to Internet development and governance.Information content regulation has become the core issue of China's network supervision at this stage.From the perspective of jurisprudence,this issue has followed the concept of modern rule of law,to regulate the legal compliance of network information content,strengthen the orderly management of the main body of the network market,and to ensure the free development of the market by establishing a system of integration of "law" and "net".Government and online markets,state intervention and freedom of expression,state regulation and platform autonomy have become the subject of today's network regulation.However,in the process of the operation of the supervisory system,powerful state power penetrates the virtual network space.While the supervision of network information content is in full swing,where is the boundary of network information content supervision? How to protect the civil cyber freedom rights? Therefore,it is necessary to clarify the statutory regulatory body,delineate the boundaries of supervision,clarify the application of regulatory tools,and implement the obligations and responsibilities of the main players in the online market.This paper focuses on the administrative regulation of network information content,and comprehensively analyzes the network information content supervision mechanism from the theoretical starting point to international experience and system design.The full text is divided into four parts,the first part is the basic theory of the article.Defining related concepts such as network information content,pointing out the necessity of supervision,controlling negativecontent and maintaining network order,regulating state power and guaranteeing freedom of expression are also the significance of supervision.Introduce the basic theory of government regulation,network supervision,and freedom of expression.The second part focuses on the regulatory status and experience of extraterritorial network powers.By analyzing the regulatory systems of the United States,the United Kingdom,Japan,and Singapore,we can horizontally compare the experiences that countries can draw on in network supervision.The third part gives a comprehensive analysis of the current status of China's current regulatory system.From the aspects of legislative level,content definition,supervision subject,means and legal responsibility,we have sorted out five aspects of system design defects through the existing supervision system:for example,the legislative level is too low;the definition of illegal information content is vague;the number of regulatory subjects Large,overlapping of authority;single means of supervision,relying on sports law enforcement;unreasonable legal responsibility.The fourth part proposes a solution to the above problems.First,we must integrate low-level norms and regulations,and improve the legislative level of network information content;second,we must clarify the scope and standards of supervision content;third,we must give full play to the supervision effectiveness of the association under the guidance of the government;fourth,we must play the regulatory role of intelligent network technology tools;It is necessary to compact the responsibility of the supervision body of the network platform and urge it to fulfill its review obligations. |
