Research On The Travel Accessibility Legal Environment In China

The research on accessibility theory in western countries has been carried out since the beginning of the 20~thh century,and has developed quite mature till now.But the research on accessibility theory in China only began to sprout in the 1980s,and“Code for the Design of urban roads and buildings accessible to the disabled”,formulated in 1989,is the first attempt of the accessibility theory in China on the legislative level.“travel accessibility”is a branch concept of the barrier-free theory,which means that the disabled,the elderly and other social groups should be considered and treated equally with other ordinary members of society in terms of environmental construction and legislative protection,so as to enhance the possibility for each member of society,including the disabled,the elderly and other social groups,to fully enjoy and realize their rights and interests of travel.Under the current social background of our country,to create a good travel accessibility legal environment not only meets the needs of the aging and other social conditions,but also contributes to the protection of travel rights and interests.The travel accessibility legal environment consists of three elements:the travel accessibility legal system,the travel accessibility legal enforcement and the citizens'awareness of travel accessibility,and the perfect travel accessibility legal system is the primary link of the construction of the travel accessibility legal environment.At present,taking the case of the disabled,our country has initially established the travel accessibility legal system,which is dominated by the“travel law”and“the law on the protection of disabled”,supplemented by the relevant laws,administrative regulations,local regulations and departmental regulations concerning the travel accessibility,formed the travel accessibility legal environment,and made some achievements.But there are still some deficiencies need to be improved and improved.At the same time,many developed countries started early in the legislation of accessibility environment construction,and their early experience of the accessibility legislation construction is of great reference significance for improving the travel accessibility legal environment in China.In this article,first of all,the author will start with the related concepts of barrier,travel accessibility and legal environment;secondly,the author will generalize and grasp the current situation of China's travel accessibility legal system,and then analyze the existing problems of China's travel accessibility legal environment from the travel accessibility legal system,the travel accessibility legal enforcement and the citizens'awareness of travel accessibility of three aspects:the backward legislative idea,the lack of supporting legislation,the low application rate of some regulations,the lack of enforcement coordination of social organization,lower citizens'awareness of travel accessibility;finally,by learning from the relevant experience of accessibility legislation construction in developed countries,this article will put forward specific suggestions for further improving the travel accessibility legal environment in China:changing the legislative idea to universal design,formulating supporting legislation,raising the application rate of regulations,perfecting the enforcement coordination of social organization,raising citizens'awareness of travel accessibility.
