In the 21st century, our humanity has entered the information age. However; the rapid development of information has brought about the digital divide between countries or areas. In order to solve the problem, each country has adopted legal mechanism of universal telecommunication service so that people in the backward area or with low income can get equal telecommunication service.In this article, firstly, the author introduces the general theory on the legal mechanism of universal telecommunication service. Then, the author analyzes the present situation of the universal telecommunication service in China. At present, although the telecommunication service has achieved rapid development, the task of constructing the universal telecommunication service is still arduous, especially in the countryside and the west area of China. "The Telecommunication Rules" of China is so ambiguous on stipulating the universal telecommunication service that during the implementation time, the suitable legal basis cannot be found. In the monopoly management time, the telecommunication enterprise achieved the goal of universal telecommunication service through internal overlapping subsidy. While after the reform of telecommunications system, the telecommunications enterprise lacks the impetus to invest the universal telecommunication service because it doesn't bring any repayment. So how to carry out the universal telecommunication service? Moreover, after China joined WTO, the telecommunication market is facing the full opening. Then how to establish fair, transparent and ordered market competition environment? Those questions all bring great challenge to the legislation of our country. In order to perfect the legislation of universal telecommunications service, we can draw on the experience of constructing the universal service of other countries.
