Study On Copyright Protection Of Copies

The so-called copying is the act of a specialist that copying a work depending solely on the skills of himself without the support from external devices.From various kinds of levels,copying could be divided into various kinds of types.The original work is the work created first but the copy is mainly realized through copying of the original work,therefore,compared with the original work,the copy has no innovation and originality but rather deep traces of imitation and replication,it is mutually interdependent with the original work and it has large market space due to its features.The property of natural person of the copier shows that the copy has printed “individual style”.If the significance of this “individual style” is so strong,it could realize the regulations required by “originality” within the copyright law,and meanwhile meet the basic factors that the work should have,the copy has become the work with the original property virtually at the moment.This thesis has analyzed the features of the copy from four aspects including subservience and compliance with the blueprint of the original work,approximation with the original work,nonindependence of the copyright and effective spread of the original work based on the definition of concept in copy and discussed the basis for legal philosophy of the protection of copyright on the copy from three dimensions that benefit analysis within copyright system,factors influencing limit and anti-limit on the copyright and principles that limit and anti-limit on the copyright should follow;it has explored the present situation of protection of copies from legislation and judicial practice;it has induced issues such as unclear definition of copy works and copy products,the fake and copies in copyright protection of copies in our country,undefined modes of copyright protection of copies and lack of proof on protection of copyright of copies in judicial practice;we put forward corresponding solutions on these issues through argumentation,that is,making clear the protection modes of copies through defining concepts of copy works,copy products,the fake and copies in detail,improving the proof system of protection of copyright of copies and protection system of copyright of copies in our country continuously,thus,it could further standardize the order of cultural arts market in our country and provide corresponding legal foundation for the judicial practice of copies,which drive the coordinated development in the economy,culture undertakings and legal system in our country.
