International Protection Of Copyright In TV Programs

In recent years,with the increasing frequency of international trade related to variety shows(or TV programs),the lack of corresponding protection at the international and domestic levels,the benefits of the law "aphasia" have become more prominent.The development of multimedia technology has made the content and presentation of variety shows more diverse,and it has brought new challenges to the definition of legal protection and legal concepts.Among them,the issue of copyright protection of variety shows is particularly prominent.Previous research has often focused on whether the program formats can be used as a copyright object.However,this issue is highly controversial both internationally and domestically,and the relevant theoretical foundations have not provided strong support.The discussion of copyright protection from the variety show is inseparable from the international trade environment.The legal issues behind international trade disputes are worth noting.The introduction of this thesis mainly introduces the basis of this topic and the research status at home and abroad and puts forward the core issues faced by the international protection of the copyright of variety programs.The first chapter of the thesis analyzes the characteristics of the variety show and the problems that need to be regulated and the need to regulate at the international level.Then through theoretical analysis,it discusses the mode selection of legal protection for variety shows,points out the limitations of the adjustment of legal issues of variety shows through the anti-unfair competition law or contract law,and draws the conclusion of protection through copyright-related systems.On the basis of overcoming the obstacles of copyright protection of variety programs,this paper discusses the theoretical basis and possible obstacles behind the international protection of variety programs by combing the international copyright principles and copyright related international treaties.The third chapter of the article examines the international laws and regulations,the relevant laws on the protection of foreign variety shows,and the protection measures embodied in specific cases by analyzing international treaties,national legislation and related cases.The fourth chapter analyzes the status quo of copyright protection in China's variety show and puts forward relevant suggestions for China based on the experience of international organizations and national laws.The fourth chapter is based on the current situation of copyright protection in China combined with the experience in the previous research in this article,puts forward relevant suggestions for the construction and improvement of the copyright protection mechanism for China,and put forward several suggestions for the international protection of variety programs.
