| Giving the municipalities with districts legislative power is a major amendment made in the Legislative Law of 2015.It is also an important measure for China to deepen the reform in an all-round way and enter key areas.It is also an important measure to improve the local legislative system,help local governments solve social contradictions,promote the modernization of local governance capacity and governance system,and standardize social behavior.The amendment and improvement of the Constitution in 2018 further clarifies the legislative powers of the municipal people’s congresses and their standing committees with districts.Given the legislative power of the municipalities with districts,the local reform can be justified in law,thus promoting the overall development of the country.Therefore,the districts should improve the scientific and democratic content of legislation and play the role of local legislation as far as possible.Since the implementation of the revised Legislative Law,the districts have actively formulated local laws and regulations.This paper makes a systematic analysis of the local laws and regulations formulated by 233newly-established municipal people’s congresses and their standing committees by means of empirical analysis,comparative analysis and documentary research.It combs the current situation of the municipal legislation of districts in China from the aspects of the number,distribution and content of legislation,summarizes the characteristics of the municipal legislation of districts,and combs the problems arising in the process of the municipal legislation of districts.In view of the problems arising from the municipal legislation of each district,this paper puts forward some solutions.There are two parts in this paper.The first part is the introduction,which briefly introduces the writing reasons and methods of the article,and combs the current domestic scholars’ research on the municipal legislation with districts;the second part is the main part of the article.Firstly,it combs the process of the local legislative power in our country,summarizes the significance of the municipal legislation with districts,and then formulates the local laws and regulations of the municipalities with districts in our country.The general situation is compared and analyzed.Through the above analysis,the characteristics of the municipal legislation with districts are summarized.Theproblems existing in the municipal legislation with districts are found.Finally,some suggestions are put forward to improve the problems. |
