After years of development,China's Internet medical treatment has begun to take shape,and has effectively expanded the public access to medical treatment.The government also attaches great importance to Internet medical treatment and constantly introduces new regulations to ensure its sound development.However,behind the rise of the Internet medical industry,the protection of patients' rights and interests is still inadequate.If the rights and interests of Internet medical patients are not well protected,it will cause damage to the Internet medical industry and the rights and interests of patients.2018 the diagnosis and treatment measures for the administration of the Internet(trial)"Internet hospital management approach(trial)",and "remote medical service management standard(trial)",in view of the problems of the industry has been argued before,for the Internet access to medical institutions,and service main body qualifications,medical service standard,the medical dispute,liability issues,such as more clear instructions.After careful study,it can be found that the normative documents issued by the government still have the following problems in protecting the rights and interests of Internet medical patients: the protection of privacy right of Internet medical patients is not strong,such as the lack of special legal norms and ineffective supervision of relevant subjects.There is a lack of institutionalized provisions for the inclusion of Internet medical insurance,and several institutional problems,such as the scope of reimbursement projects,pricing of medical projects and insurance fraud,need to be solved urgently.The supervision mechanism of Internet medical advertisements is not sound,such as the lack of integrity of legal provisions,the light punishment for illegal ACTS,the lack of interaction between law enforcement bodies,and the lack of socialsupervision.Drawing on the relevant experience of the United States and Europe and combining with China's actual situation,China should strengthen the legislative protection of the privacy right of Internet medical patients.Internet medical expenses should be included in the scope of basic medical insurance,medical service items reimbursed should be determined,prices of medical service items should be standardized,and fraudulent insurance should be strictly prevented.In addition,it is also necessary to strengthen the supervision of Internet medical advertisements,improve the legislation of Internet medical advertisements in China,increase the punishment intensity of illegal behaviors of Internet medical advertisements,promote the joint law enforcement of Internet medical advertisement supervision departments,and rely on social forces to assist supervision.
