With the continuous development of science and technology and the continuous deepening of information sharing,people have become deeply involved in such huge social network.The infringement of privacy rights caused by video monitoring in public places is also on the rise year by year.The traditional privacy right of "privacy stops at the door" is not enough to explain the infringement of public security monitoring under video,nor can it meet people's growing demands for rights.Therefore,people pull the privacy right from the "house" to the public place.Only on the premise of admitting the existence of privacy right in the public place,can we discuss whether the privacy right in the public place will be violated due to a series of inappropriate behaviors,and can we discuss whether the public video monitoring system has the problem of infringement.By sorting out the emergence and development trend of video monitoring system for public security,and analyzing the internal logic and legal basis of video monitoring system for public security,it is concluded that the development of video monitoring system for public security is the general trend.The development of video surveillance in public places,at the same time,the protection of the privacy rights appeal is also increasing,gradually from "privacy in the door" to the right of privacy in public places is also the right to privacy direction,at the same time also gradually in the domestic and foreign judicial precedent never admit in public places have privacy rights to privacy as a kind of personality right also exists in the public places.The importance of privacy protection is further demonstrated from the perspective of constitutional protection of "human dignity".From the "Skynet Project" to the "Xue Liang project",China's public safety monitoring system is growing exponentially in popularity.However,from the inelegant incident in Sichuan Highway to the "electronic eye" in ShenZhen to the intimate behavior of lovers exposed in ShanDong campus,we can see that our country's public security monitoring exists many problems.After acknowledging the existence of privacy in public places and analyzing the importance of privacy protection,this paper enumerates the cases of real public video monitoring invasion of privacy,and leads to the situation that the video monitoring system has excessive exposure to personal privacy and information disclosure.Infringement problem,imperfect laws and lack of the rule of law thinking lead to be violators are difficult to get timely relief,this kind of situation need to be seriously,from the aspects of legal system construction analysis of the cause of the problem is the lack of effective special legislation,to provide a thinking direction for system construction,improve the legislation about monitoring system establishment,supervision is imperative.Based on the above research,it is proposed that the basic principles such as human rights protection should be followed,besides,special administrative legislation should be improved,specific system construction should be carried out from the aspects of installation,supervision and relief,and the implementation of legalthinking should be put forward to effectively protect the privacy right under the video monitoring system of public security.
