| The price hearing system is an important system that applies the hearing system to the government price decision-making process.And a very important type of price hearing is public utility price hearing which hearing items are the products and services that are closely related to people's livelihood,such as the price of water,electricity,heating,natural gas and rail transit.For a long time,due to our country's traditional planned economy system,most of these items are welfare or monopolistic,so their price was far off real value.Nowadays,under the background that China is deepening market-oriented reform,the law demands that when setting or adjusting utility prices,price hearings are required to hear the opinions of all parties,especially the public,the price of public utility products is closely related to all the public,and the trend of their price change is always rising.Therefore,doubts such as "hearing show" and "going through the motions" can be heard commonly.This is not only inconsistent with the public's desire to constantly participate in political life and safeguard their own interests,but also contrary to the Party Central Committee's concept of expanding public participation and constantly promoting the development of democratic politics.Under such circumstances,if we want to get out of the current predicament fundamentally,one of the important links is to optimize the public hearing participants' election system in the price hearing of public utilities.The election system of public hearing participants involves the scientificity and rationality of the result of price hearing decision.Therefore,only by constantly optimizing the public participants' election in the price hearing of public utilities,can the effectiveness of public participation be constantly improved,the fairness and rationality of the price hearing system be ensured,and the improvement of people's livelihood and well-being is promoted.Therefore,the study on it has important theoretical value and practical value.In this paper,case studies and unstructured interviews are used.By narrowing the study of the public utility price hearing system to the level of the public representative selection system in the public utility price hearing,a more targeted and feasible optimization path is made.Then,on the basis of clarifying the relevant concepts and theoretical foundations of the public participants' election system in the public utility price hearing,this paper starts from the perspective of practical cases in China and uses the price hearings held recently by Shenyang City as research carriers.What's more,Through semi-structured interviews with some public representatives of Shenyang municipal development and reform commission and some Shenyang citizens in the price hearing,and referring to relevant government announcements and news reports,The study found that in the practice of public utility price hearings in Shenyang,there are problems like single election subject,unclear election criteria,unreasonable composition of public participant and information asymmetry between the election subject and public representatives.On this basis,the reasons for the problems in the operation of public utility price hearing public Participant system is analyzed and the optimization path is proposed.Firstly,it is necessary to give public participants training and give certain reward mechanisms to encourage them to actively participate in the hearing;Secondly,the government should get rid of the specific election affairs,maintain its neutrality;Thirdly,the hearing organizers and public utility operators should work together to reduce the adverse effects of information asymmetry on the lack of public election information through reasonable institutional means.Finally,it is necessary to improve the administrative procedure law that has not been promulgated in the administrative law as soon as possible,implement the basic rules of the administrative procedure by the procedural normative law,guide the election of public representatives. |
