Study On The Reform Of Funds Guarantee System Of Primary Courts

The problem of insufficient funding and localization of the courts for a long time has become a"culprit" that hinders its independent exercise of judicial power.The central government's goal of promoting"provincial management"is to ensure the stability and independence of the court's operation,establish a scientific and rational judicial funding guarantee and management system,and promote the realization of judicial justice.This paper presents an empirical analysis of the grass-roots courts in F County,a state-level poverty-stricken county in the southwestern region of Southwest China.It shows that the reform of fund-raising in the grass-roots courts is stable,the overall level of protection is improved,and it can meet the daily operational needs,and the difference between other courts is reduced.At the same time,the standardization of budget management,the degree of standardization have increased,the level of financial management has increased,and the effectiveness of reforms has begun to emerge.However,from the perspective of capital investment,the structure and total amount have not changed fundamentally.Funding support and limited growth space have weakened the results of reforms;from the perspective of reform practice,the promotion is too hasty,communication barriers and target deviations exist between departments,and there is a "gap" in system design,which makes the reform of funds slow,and "small problems" continue;In addition,from the perspective of reform and implementation,due to the serious shortage of financial management power,limited management capacity,failure to achieve refined management,and greatly reduced the effectiveness of fund management.In view of this,in the future reform of court funding,first of all,independence should be considered.At the same time,to establish a reasonable and normal relationship between the court and other institutions,It is not only concerned with the improvement of the income level of the court or the complete disconnection of local relations.Secondly,it should pay attention to the optimization of the financial management system while considering the diversification and stability of the sources of funding protection,improve the stability and sustainability of the court funding guarantee,and establish dynamics.The funding standard system will improve the rationality of funding guarantees,improve the standardization of financial operation processes,optimize the financial management system,introduce social service purchases,and strengthen information technology management.
