Study On The Prevention And Control Of Sexual Aggression Against Minors

Minors are in a special period of physical and psychological development and maturity.Self-protection,self-management,and discrimination are lack of ability.When faced with illegal infringement,they are easily panicked,unable to or ignorant of resistance,and easily become a criminal object.According to the statistics of the Supreme People's Procuratorate,"the crime of infringement of minors is on the rise.In the crime of adults infringing on minors,the proportion of sexual assaults such as rape,childbirth,forced prostitution and organization of prostitution is relatively large.More than 70% of the cases of sexual assault in some places,more than 70% of the victims are children under the age of 14".In the 2018,the Supreme People's Court issued 10 cases of “using the Internet to infringe upon the legitimate rights and interests of minors”.Six cases were cases of sexual aggression against minors.The proportion is high and disturbing.Sexual assault on minors seriously infringes the sexual rights of minors and has a far-reaching adverse impact on the healthy development of minors' physical and mental health.Minors are the future of the motherland,the hope of the nation,bearing the hope of building a better future for the motherland,and the expectations of each family to create a better life.Their healthy growth is tied to the joint efforts of all sectors of society.In order to better protect the legitimate rights and interests of minors,this paper will use the combination of literature research and empirical research to take the data on sexual assault of minors from K-2013 in Henan Province from 2013 to 2017 as the basic research sample.The analysis of crime-like data,summarizing and studying the characteristics of sexual assault cases involving minors in the region,analyzing the causes of crimes,and proposing preventive measures.In addition to the introduction and conclusion,this article is divided into three parts:The first part analyzes 201 cases and focuses on the crimes,the minors and the perpetrators,and summarizes the characteristics of sexually assaulted minors in K city from 2013 to 2017.Through the use of data analysis,charts,cases and other forms,it can directly reflect the types of crimes of sexual aggression against minors,the variety of crimes,the high proportion of acquaintances,the obvious ageing of the victims,the problem of inadequate supervision,and the participation of minors.And the implementation of crime issues highlights and other characteristics.The second part is a multi-dimensional analysis of the causes of sexual assault on minors.As a social phenomenon,crime is complicated and inevitable,and there are deep social reasons behind any criminal phenomenon.By analyzing the causes of crime formation and improving the crime prevention mechanism,it can effectively reduce the damage caused by criminal behavior.The psychology of the minor is immature,curious about sex but lacks sufficient self-protection ability to increase its victimization;the low self-control of the offender and the high concealment of sexual crimes have all contributed to it to some extent.The criminal tendency can not be effectively controlled and slipped into the abyss of crime;the disorder of the social environment and the loopholes of social supervision make the illegality escalate into a crime;the lack of legal system makes it weaken the ability to correct social disorder,and can not effectively curb the recurrence of crime,the above factors The cross-integration has caused sexual abuse of minors to commit crimes frequently.The third part will combine the characteristics and causes of crimes,and propose the author's suggestions on the protection of minors' rights and interests and the prevention of sexual aggression against minors.Preventing and reducing the incidence of sexual assault on minors is the ultimate goal of studying this issue.It is also the original intention of the author to write this paper.To achieve this goal depends on the joint efforts of minors,families,society and the state.As a direct victim of such crimes,minors can enhance their self-protection awareness and learn the skills and abilities to cope with the crisis.They can effectively avoid harming themselves and enable criminals to be punished in a timely manner.Family,society and the state as external protection bodies must Improve the guardianship ability of guardians,comprehensively popularize sexual education,especially prevent sexual assault education,improve the social governance system,strengthen social supervision,especially network supervision,form a fine and sensitive comprehensive protection network,and create a good family and social environment for the growth of minors.As an important means of preventing and punishing crimes,the law should unify the standards for criminal identification,improve the mandatory reporting system,the child pornography prohibition system,and the victim's minor aid mechanism,minimizing secondary harm and minimizing the damage caused by crime.
