On The Procuratorial Supervision Mode Of The Change Of Penalty Execution

In recent years,many leaders of the judicial administration system at the provincial level have committed many extra-large and major official crimes,and many top officials have fallen from power.These phenomena have also exposed the shortcomings of the judicial administration system in China,and the procuratorial organs,as the subject of supervision over the implementation of criminal punishment in China,bear irreplaceable responsibilities.In the reform of China's judicial administrative system,prison,as the penalty execution organ of the state,is an important part of the reform.As the former minister of justice zhang jun said,"prison management should not only realize the bottom line security,but also be responsible for social security and fundamental security,so as to realize the overall national security concept".However the current our country jail collective corruption are common,and even a litter case series case are way down on corruption,such as this with our country supervision strength is not enough,on the prison prison "head" can and make them,have a lot to do,and how the procuratorial organs supervise judicial administrative organs,especially the penalty enforcement agencies is particularly important.The first part of this paper first briefly discusses the purpose and significance of this research,at the same time,by sorting out and summarizing the research status at home and abroad,provides a solid theoretical basis for this research.The second part explains the phenomenon of "soft prison break" through typical cases happened in prison system in recent years,and summarizes the characteristics and harmfulness of "soft prison break".Aiming at the "soft prison break" problem of some criminals at present,this paper analyzes the current penalty implementation change and the loopholes in prison management,so as to further dig into the root cause of "soft prison break" phenomenon,that is,the problems of procuratorial supervision mode.The third part is on the basis of discussing the current situation of the supervision mode of the change of penalty execution in China,the author makes a comparative analysis of the procuratorial supervision mode of the change of penalty execution in China,proposes to improve the change of penalty execution in China,and carries out the synchronous supervision mode before,during and after the execution.The fourth part is the author based on their daily work experience and summary,put forward Suggestions to improve the implementation of penalty change system in China:the establishment of a special criminal enforcement law;Focus on the supervision of the "top brass";Focusing on strengthening prison management;Improving the four supporting systems;Optimize and enrich the supervision methods to effectively solve the "soft escape",problein of "three types of criminals" and better safeguard judicial justice.
